نَا نَا ابْنُ الْجُنَيْدِ ، نَا زِيَادُ بْنُ أَيُّوبَ ، نَا الْقَاسِمُ بْنُ مَالِكٍ ، نَا لَيْثٌ ، عَنِ الْحَكَمِ ، قَالَ : قَالَ عَلِيٌّ ، وَابْنُ مَسْعُودٍ : إِذَا قَتَلَ الْحُرُّ الْعَبْدَ مُتَعَمِّدًا فَهُوَ قَوَدُهُ " ، لا تَقُومُ بِهِ حَجَّةٌ ، لأَنَّهُ مُرْسَلٌ.
Sayyiduna Ali (may Allah be pleased with him) and Sayyiduna Abdullah ibn Mas'ud (may Allah be pleased with him) say: "When a free person deliberately kills a slave, then (in this case, retribution will not be taken) rather, blood money will be paid." (Imam Daraqutni, may Allah have mercy on him, says:) This narration cannot be used as evidence, because it is mursal.
