Hadith 3186

نَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ ، نَا عَبْدِ الْكَرِيمِ بْنُ الْهَيْثَمِ ، نَا سَعِيدُ بْنُ سُلَيْمَانَ سَعْدَوَيْهِ ، عَنْ عَبَّادٍ ، عَنْ حَجَّاجٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : خَرَجَ مُحَيِّصَةُ ، وَحُوَيِّصَةُ ابْنَا مَسْعُودٍ ، وَعَبْدُ الرَّحْمَنِ ، وَعَبْدُ اللَّهِ بْنُ سَهْلٍ ، إِلَى خَيْبَرَ يَمْتَارُونَ فَتَفَرَّقُوا لِحَاجَتِهِمْ ، فَمَرُّوا بِعَبْدِ اللَّهِ بْنِ سَهْلٍ قَتِيلا ، فَرَجَعُوا إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَخْبَرُوهُ ، فَقَالَ لَهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " تَحْلِفُونَ خَمْسِينَ يَمِينًا قَسَامَةً تَسْتَحِقُّونَ بِهِ قَاتِلَكُمْ ؟ ، فَكَرِهُوا ، فَقَالُوا : يَا رَسُولَ اللَّهِ ، نَحْلِفُ عَلَى الْغَيْبِ ، نَحْلِفُ عَلَى أَمْرٍ غِبْنَا عَنْهُ ؟ ، قَالَ : فَتَحْلِفُ الْيَهُودُ خَمْسِينَ يَمِينًا فَيَبْرَءُونَ ، فَقَالُوا : يَا رَسُولَ اللَّهِ ، نَقْبَلُ أَيْمَانَ قَوْمٍ كُفَّارٍ ؟ ، فَأُتِيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمَالٍ مِنْ مَالِ الصَّدَقَةِ ، فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ " .
Amr bin Shu'aib narrates from his father, who narrates from his grandfather: Sayyiduna Muhayyisa bin Mas'ud (may Allah be pleased with him), Sayyiduna Huwayyisa bin Mas'ud (may Allah be pleased with him), Sayyiduna Abdur Rahman bin Sahl (may Allah be pleased with him), and Sayyiduna Abdullah bin Sahl (may Allah be pleased with him) went to Khaybar. There, these gentlemen separated from each other for their work, then they found Sayyiduna Abdullah bin Sahl (may Allah be pleased with him) murdered. These gentlemen returned and presented themselves before the Prophet Muhammad (peace and blessings be upon him) and informed him about this matter. The Prophet (peace and blessings be upon him) said to them: "You may have fifty people swear an oath as qasamah and thus punish the killer." But this was not acceptable to them. They said: "O Messenger of Allah! How can we swear an oath about the unseen? How can we swear about a matter in which we were not present?" The Prophet (peace and blessings be upon him) said: "Then fifty people from the Jews will swear an oath and be acquitted." They said: "O Messenger of Allah! Should we accept the oaths of the disbelievers?" (The narrator says:) Then zakat wealth was brought to the Prophet (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) himself paid the blood money (diyah) for the murdered man.
