Hadith 3142

نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، أنا عَبْدُ الرَّزَّاقِ ، أنا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي ابْنُ طَاوُسٍ ، عَنْ أَبِيهِ ، قَالَ : عِنْدَ أَبِي كِتَابٌ فِيهِ ذِكْرُ الْعُقُولِ ، جَاءَ بِهِ الْوَحْيُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ مَا قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عَقْلٍ أَوْ صَدَقَةٍ فَإِنَّمَا جَاءَ بِهِ الْوَحْيُ فَفِي ذَلِكَ الْكِتَابِ ، وَهُوَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : قَتْلُ الْعَمِيَّةِ دِيَتُهُ دِيَةُ الْخَطَأِ ، الْحَجَرُ ، وَالْعَصَا ، وَالسَّوْطُ مَا لَمْ يَحْمِلْ سِلاحًا " .
The son of Tawus narrates from his father: My father had a written document in which there were rulings regarding different types of blood money (diyah), which were conveyed to the Prophet Muhammad (peace be upon him) through revelation. Whatever decisions the Prophet Muhammad (peace be upon him) made regarding blood money and charity were all according to revelation. In that book, it was written regarding the Prophet Muhammad (peace be upon him): (He, peace be upon him, said:) "The blood money for accidental killing will be the blood money for unintentional killing, such as if someone is killed by a stone, stick, or staff, while the killer did not raise a weapon."
