نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، أنا عَبْدُ الرَّزَّاقِ ، أنا ابْنُ جُرَيْجٍ ، أَخْبَرَ عَمْرُو بْنُ دِينَارٍ ، أَنَّهُ سَمِعَ طَاوُسًا ، يَقُولُ : " الرَّجُلُ يُصَابُ فِي الرِّمِّيَّا فِي الْقِتَالِ بِالْعَصَا ، أَوْ بِالسِّيَاطِ ، أَوْ بِالتَّرَامِي بِالْحِجَارَةِ يُودَى وَلا يُقْتَلُ بِهِ مِنْ أَجْلِ أَنَّهُ لا يَعْلَمُ مَنْ قَاتِلُهُ ، وَأَقُولُ : أَلا تَرَى إِلَى قَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْهُذَلِيَّتَيْنِ ضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بِعَمُودٍ فَقَتَلَتْهَا أَنَّهُ لَمْ يَقْتُلْهَا بِهَا وَوَدَاهَا وَجَنِينَهَا " . أَخْبَرَنَاهُ ابْنُ طَاوُسٍ ، عَنْ أَبِيهِ لَمْ يُجَاوَزْ طَاوُسٌ.
Tawoos narrates: If during a fight, a person is killed by being struck with a stick, staff, or stone, his blood money (diyah) will be paid, and he will not be killed in retaliation, because it is not known who his killer is. I say: Have you not observed the decision of the Prophet Muhammad (peace be upon him) in the case of the two women from the tribe of Huzail? One of the two women struck the other with a stick and killed her, so the Prophet (peace be upon him) did not have the woman who killed executed in retaliation for the murdered woman, but instead, he ordered the payment of blood money for the murdered woman and for the child in her womb. This hadith has been narrated by the son of Tawoos from his father.
