Hadith 3133

نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ عَبَّادٍ ، نَا عَبْدُ الرَّزَّاقِ ، عَنِ الْحَسَنِ بْنِ عُمَارَةَ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ طَاوُسٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ قُتِلَ فِي عِمِّيَّا رِمِّيَّا بِحَجَرٍ ، أَوْ ضَرْبًا بِعَصًا ، أَوْ سَوْطٍ فَعَقْلُهُ عَقْلُ الْخَطَأِ ، وَمَنْ قَتَلَ اعْتِبَاطًا فَهُوَ قَوَدٌ لا يُحَالُ بَيْنَهُ وَبَيْنَ قَاتِلِهِ ، فَمَنْ حَالَ بَيْنَهُ وَبَيْنَ قَاتِلِهِ ، فَعَلَيْهِ لَعْنَةُ اللَّهِ ، وَالْمَلائِكَةِ ، وَالنَّاسِ أَجْمَعِينَ ، لا يُقْبَلُ مِنْهُ صَرْفٌ وَلا عَدْلٌ " .
Tawoos narrates from Sayyiduna Ibn Abbas (may Allah be pleased with them both): The Noble Prophet (peace and blessings be upon him) said: "Whoever is killed by mistake, or is killed by a stone, or is killed by a stick or staff, then his blood money will be the blood money for accidental killing. And whoever is killed intentionally, then there will be retribution (qisas) for him, and nothing will come between him and his killer. Whoever comes between that person and his killer, upon him will be the curse of Allah, His angels, and all people. None of his obligatory or voluntary acts of worship will be accepted."
