حَدَّثَنَا مُوسَى بْنُ جَعْفَرِ بْنِ قَرِينٍ ، نَا فَهْدُ بْنُ سُلَيْمَانَ ، نَا مُوسَى بْنُ دَاوُدَ ، نَا سُفْيَانُ الثَّوْرِيُّ ، عَنْ عَمْرِو بْنِ دِينَارٍ ، عَنْ مُجَاهِدٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لَيْسَ عَلَى الْعَبْدِ الآبِقِ إِذَا سَرَقَ قَطْعٌ ، وَلا عَلَى الذِّمِّيِّ " ، لَمْ يَرْفَعْهُ غَيْرُ فَهْدٍ ، وَالصَّوَابُ مَوْقُوفٌ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "When a runaway slave commits theft, his hand is not to be cut off, nor is the hand of a dhimmi to be cut off." This narration has been transmitted as a marfu‘ hadith only by the narrator named Fahd; the correct view is that this narration is mawquf.
