ثنا يَحْيَى بْنُ صَاعِدٍ ، نَا سَوَّارُ بْنُ عَبْدِ اللَّهِ الْعَنْبَرِيُّ ، نَا مُعْتَمِرُ بْنُ سُلَيْمَانَ ، عَنْ لَيْثٍ ، عَنْ مُجَاهِدٍ ، عَنِ ابْنِ عُمَرَ ، وَأَبِي هُرَيْرَةَ الْحَدِيثَ ، قَالَ : " لا يَبِيعُ حَاضِرٌ لِبَادٍ ، وَلا تَلَقَّوُا السِّلَعَ بِأَفْوَاهِ الطُّرُقِ ، وَلا تَنَاجَشُوا ، وَلا يَسِمُ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ ، وَلا يَخْطِبُ عَلَى خِطْبَةِ أَخِيهِ حَتَّى يَنْكِحَ أَوْ يَرُدَّ ، وَلا تَسْأَلُ الْمَرْأَةُ طَلاقَ أُخْتِهَا لِتَكْتَفِئَ مَا فِي صَحْفَتِهَا ، فَإِنَّمَا لَهَا مَا كُتِبَ لَهَا ، وَلا تَبِيعُوا الْمُصَرَّاةَ مِنَ الإِبِلِ وَالْغَنَمِ ، فَمَنِ اشْتَرَاهَا فَهُوَ بِالْخِيَارِ إِنْ شَاءَ رَدَّهَا وَصَاعًا مِنْ تَمْرٍ ، وَالرَّهْنُ مَرْكُوبٌ وَمَحْلُوبٌ " .
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) and Sayyiduna Abu Hurairah (may Allah be pleased with him) have narrated as a marfu‘ hadith: (The Noble Prophet, peace and blessings be upon him,) said: “A townsman should not sell on behalf of a villager; do not buy goods (of a caravan) on the way before they reach the market; do not artificially raise bids; no one should offer a price against the price offered by his brother; no one should send a marriage proposal against the proposal of his brother, until the other person marries or withdraws his proposal; no woman should demand the divorce of her sister (co-wife) so that she may obtain her share of benefits, for she will only get what is decreed for her; do not sell a musarrat she-camel or goat (one whose milk is tied up); whoever buys it has the option, if he wishes, to return it with one sa‘ of dates; the milk of an animal held in pledge may be milked and it may be ridden.”
