ثنا الْحُسَيْنُ بْنُ سَعِيدِ بْنِ الْحَسَنِ بْنِ يُوسُفَ الْمَرْوَزيُّ ، قَالَ : وَجَدْتُ فِي كِتَابِ جَدِّي ، نَا مُحَمَّدُ بْنُ الْحَسَنِ ، نَا أَبُو حَنِيفَةَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي يَزِيدَ ، كَذَا قَالَ : عَنْ أَبِي نَجِيحٍ ، عَنِ ابْنِ عَمْرٍو ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " إِنَّ اللَّهَ حَرَّمَ مَكَّةَ ، فَحَرَامٌ بَيْعُ رِبَاعِهَا ، وَأَكْلُ ثَمَنِهَا ، وَقَالَ : مَنْ أَكَلَ مِنْ أَجْرِ بُيُوتِ مَكَّةَ شَيْئًا ، فَإِنَّمَا يَأْكُلُ نَارًا " ، كَذَا رَوَاهُ أَبُو حَنِيفَةَ مَرْفُوعًا ، وَوَهِمَ أَيْضًا فِي قَوْلِهِ : عُبَيْدُ اللَّهِ بْنُ أَبِي يَزِيدَ ، وَإِنَّمَا هُوَ ابْنُ أَبِي زِيَادٍ الْقِدَاحُ ، وَالصَّحِيحُ أَنَّهُ مَوْقُوفٌ.
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) narrates this statement of the Noble Prophet (peace and blessings be upon him): "Allah Almighty has declared Makkah as a sanctuary; selling its land and consuming its price is forbidden." The Prophet (peace and blessings be upon him) also said: "Whoever consumes anything from the compensation (i.e., rent) of the houses of Makkah, he will be consuming fire." Imam Abu Hanifa (may Allah have mercy on him) has transmitted this narration as a marfu' (attributed to the Prophet) narration in this manner; however, he made an error in this. His second error was that he mentioned the narrator's name as Ubaydullah bin Abi Yazid, whereas it is Ibn Abi Ziyad. The correct view is that this narration is mawquf (stopped at the companion).
