ثنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ ، نَا ابْنُ أَبِي فُدَيْكٍ ، عَنِ ابْنِ أَبِي ذِئْبٍ ، عَنْ مَخْلَدِ بْنِ خُفَافِ بْنِ إِيمَاءِ بْنِ رُخْصَةَ الْغِفَارِيِّ ، أَنَّ عَبْدًا كَانَ بَيْنَ شُرَكَائِهِ فَبَاعُوهُ وَرَجُلٌ مِنَ الشُّرَكَاءِ غَائِبٌ ، فَلَمَّا قَدِمَ أَبَى أَنْ يُجِيزَ بَيْعَهُ ، فَاخْتَصَمُوا فِي ذَلِكَ إِلَى هِشَامِ بْنِ إِسْمَاعِيلَ ، فَقَضَى أَنْ يُرَدَّ الْبَيْعُ وَيَتَبَايَعُوهُ الْيَوْمَ ، وَيُؤْخَذُ مِنْهُ الْخَرَاجُ ، وَوُجِدَ الْخَرَاجُ فِيمَا مَضَى مِنَ السَّنَتَيْنِ أَلْفُ دِرْهَمٍ ، قَالَ : فَبِيعَ فِيهِ غُلامَانِ لَهُ ، قَالَ : فَجِئْتُ إِلَى عُرْوَةَ بْنِ الزُّبَيْرِ فَذَكَرْتُ لَهُ ذَلِكَ ، فَقَالَ حَدَّثَتْنِي عَائِشَةُ ، " أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ " ، فَدَخَلَ عُرْوَةُ عَلَى هِشَامٍ فَحَدَّثَهُ بِذَلِكَ فَرَدَّ بَيْعَ الْغُلامَيْنِ ، وَتَرَكَ الْخَرَاجَ.
Sayyiduna Mukhlid bin Khafaf (may Allah be pleased with him) narrates that a slave was jointly owned by some people. Those people sold him, but one of the partners was absent. When he came, he refused to accept the transaction. Those people brought their case to Hisham bin Isma'il, so he ruled that the transaction would be annulled and that the sale should be made according to the rate of that day, and that the kharaj (revenue) should be collected. Then, the kharaj for the two years that had passed amounted to one thousand dirhams, so two slaves were sold in exchange for that slave. I went to the service of 'Urwah bin Zubair and mentioned this matter to him, so he said: Lady Aisha narrated this hadith to me: The Prophet (peace and blessings of Allah be upon him) ruled that the kharaj would be according to the period of possession. Then 'Urwah went to Hisham and informed him about this, so he annulled the transaction of those two slaves and abandoned the kharaj.
