ثنا أَحْمَدُ بْنُ إِسْحَاقَ بْنِ بُهْلُولٍ ، نَا أَبِي ، نَا يَعْلَى ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ ، عَنْ يَحْيَى وَ ، هِشَامٍ ابْنِي عُرْوَةَ ، عَنْ عُرْوَةَ ، أَنَّ رَجُلَيْنِ مِنَ الأَنْصَارِ اخْتَصَمَا فِي أَرْضٍ غَرَسَ أَحَدُهُمَا فِيهَا نَخْلا وَالأَرْضُ لِلآخَرِ ، " فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وُضُوءَ لِصَاحِبِهَا ، وَأَمَرَ صَاحِبَ النَّخْلِ أَنْ يُخْرِجَ نَخْلَهُ ، وَقَالَ : مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لِمَنْ أَحْيَاهَا ، وَلَيْسَ لِعَرَقِ ظَالِمٍ حَقٌّ " ، قَالَ : فَلَقَدْ أَخْبَرَنِي الَّذِي حَدَّثَنِي بِهَذَا الْحَدِيثِ أَنَّهُ رَأَى النَّخْلَ وَهِيَ عَمٌّ ، تُقْلَعُ أُصُولُهَا بِالْفُؤُوسِ ، قَالَ ابْنُ إِسْحَاقَ : الْعَمُّ : الشَّبَابُ ، وَلَيْسَ لِعَرَقِ ظَالِمٍ حَقٌّ ، قَالَ : " أَنْ تَأْتِيَ أَرْضَ غَيْرِكَ فَتَزْرَعَ فِيهَا ".
Urwah narrates that there was a dispute between two men from among the Ansar regarding a piece of land. One of them had planted a date-palm tree there, and the land belonged to the other. So the Prophet (peace and blessings be upon him) decided that the land would go to its owner, and he said to the one who had planted the tree: "Take your tree out from there." He said: "Whoever revives a barren land, it belongs to the one who revived it, but no one can plant anything on another person's land (by force)." The narrator says: The person who narrated this tradition to me informed me that he had seen that date-palm tree, which was very tall and high, and its roots had been cut with an axe. These words of the narration are not for an oppressor; what is meant is that you go into someone else's land and start cultivating it (i.e., do so without his consent).
