ثنا ثنا أَبُو سَهْلٍ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ زِيَادٍ ، نَا عُبَيْدُ بْنُ شَرِيكٍ ، نَا ابْنُ أَبِي مَرْيَمَ ، نَا مُحَمَّدُ بْنُ جَعْفَرٍ ، أَخْبَرَنِي ابْنُ أَبِي حَرْمَلَةَ ، قَالَ : سَمِعْتُ سَعِيدَ بْنَ الْمُسَيِّبِ ، أَنَّ مَوْلًى لأُمِّ حَبِيبَةَ أَفْلَسَ ، فَأُتِيَ بِهِ عُثْمَانَ بْنَ عَفَّانَ ، فَقَضَى فِيهِ عُثْمَانُ ، " أَنْ مَنْ كَانَ اقْتَضَى مِنْ حَقِّهِ شَيْئًا قَبْلَ أَنْ يُفْلِسَ فَهُوَ لَهُ ، وَمَنْ عَرَفَ مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ " .
Saeed bin Musayyib narrates that the slave of Sayyidah Umm Habibah (may Allah be pleased with her) was declared insolvent. He was brought to Sayyiduna Uthman (may Allah be pleased with him), so regarding him, Sayyiduna Uthman gave this verdict: "Whoever had taken something of his right before he was declared insolvent, that belongs to him, and whoever finds his goods exactly as they were with him, he has more right to those goods."
