حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الْحَكَمِ ، نَا ابْنُ أَبِي فُدَيْكٍ ، نَا ابْنُ أَبِي ذِئْبٍ ، قَالَ حَدَّثَنِي ابْنُ عَمْرِو بْنِ نَافِعٍ ، عَنِ ابْنِ خَلْدَةَ الزُّرَقِيِّ ، وَكَانَ قَاضِيَ الْمَدِينَةِ ، أَنَّهُ قَالَ : جِئْنَا أَبَا هُرَيْرَةَ فِي صَاحِبٍ لَنَا أَفْلَسَ ، فَقَالَ : هَذَا الَّذِي قَضَى فِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : أَيُّمَا رَجُلٍ مَاتَ أَوْ أَفْلَسَ ، فَصَاحِبُ الْمَتَاعِ أَحَقُّ بِمَتَاعِهِ إِذَا وَجَدَهُ بِعَيْنِهِ " .
Ibn Khuldah Zurqi, who was the judge of Madinah Munawwarah, narrates that we went to Sayyiduna Abu Hurairah (may Allah be pleased with him) regarding one of our companions who had become insolvent. Sayyiduna Abu Hurairah (may Allah be pleased with him) informed us: This is the issue about which the Noble Prophet (peace and blessings be upon him) gave this verdict: "Whoever dies or is declared insolvent, and then the owner of some goods finds his goods in their original form with him, then he has the greatest right to that property."
