نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، وَالْحُسَيْنُ بْنُ يَحْيَى بْنِ عَيَّاشٍ ، قَالا : نَا الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ ، نَا شَبَابَةُ ، نَا ابْنُ أَبِي ذِئْبٍ ، عَنْ أَبِي الْمُعْتَمِرِ ، عَنْ عُمَرَ بْنِ خَلْدَةَ الأَنْصَارِيِّ ، قَالَ : جِئْنَا أَبَا هُرَيْرَةَ " فِي صَاحِبٍ لَنَا أُصِيبَ لِهَذَا الدَّيْنِ يَعْنِي أَفْلَسَ ، فَقَالَ : ثُمَّ قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي رَجُلٍ مَاتَ أَوْ أَفْلَسَ ، أَنَّ صَاحِبَ الْمَتَاعِ أَحَقُّ بِمَتَاعِهِ إِذَا وَجَدَهُ بِعَيْنِهِ أَنْ يَتْرُكَ صَاحِبَهُ وَفَاءً " .
Umar bin Khaldah Ansari narrates that we went to the service of Sayyiduna Abu Hurairah (may Allah be pleased with him) regarding one of our companions who had been declared insolvent due to illness. Sayyiduna Abu Hurairah (may Allah be pleased with him) informed us: The Noble Prophet (peace and blessings be upon him) had given this verdict regarding such a person who had passed away or who had become insolvent: "When the real owner of the goods finds his property in its original form with someone, he has more right to that property, but he should give his companion full payment (i.e., the share that belongs to that companion)."
