ثنا ابْنُ صَاعِدٍ ، نَا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى ، عَنِ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ عَبْدِ اللَّهِ أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا اخْتَلَفَ الْبَيِّعَانِ وَالْمَبِيعُ مُسْتَهْلَكٌ ، كَانَ الْمُبْتَاعُ بِالْخِيَارِ إِنْ شَاءَ أَخَذَ ، وَإِنْ شَاءَ تَرَكَ " ، تَفَرَّدَ بِهَذَا اللَّفْظِ أَبُو الأَحْوَصِ الْقَاضِي ، عَنْ هِشَامٍ.
Qasim bin Abdur Rahman narrates from his father, who narrates from his grandfather, that the Prophet Muhammad (peace be upon him) said: "When there is a dispute between two parties involved in a transaction and the sold item has been lost, then the buyer has the option; if he wishes, he may take it, and if he wishes, he may leave it." In narrating this tradition with these words, the narrator named Abu Ahwas is unique, who has narrated it from Hisham.
