ثنا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا الْعَبَّاسُ بْنُ مُحَمَّدٍ ، نَا عُمَرُ بْنُ حَفْصِ بْنِ غِيَاثٍ ، عَنْ أَبِيهِ ، عَنْ أَبِي عُمَيْسٍ ، نَا عَبْدُ الرَّحْمَنِ بْنُ قَيْسِ بْنِ مُحَمَّدِ بْنِ الأَشْعَثِ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : اشْتَرَى الأَشْعَثُ بْنُ قَيْسٍ رَقِيقًا مِنْ رَقِيقِ الْخُمُسِ مِنْ عَبْدِ اللَّهِ بِعِشْرِينَ أَلْفًا ، فَأَرْسَلَ عَبْدُ اللَّهِ فِي ثَمَنِهِمْ ، قَالَ : إِنَّمَا أَخَذْتُهُمْ بِعَشَرَةِ آلافٍ ، قَالَ عَبْدُ اللَّهِ : فَاخْتَرْ رَجُلا يَكُونُ بَيْنِي وَبَيْنَكَ ، فَقَالَ الأَشْعَثُ : أَنْتَ بَيْنِي وَبَيْنَ نَفْسِكَ ، قَالَ عَبْدُ اللَّهِ : فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " إِذَا اخْتَلَفَ الْبَيِّعَانِ وَلَيْسَتْ بَيِّنَةٌ ، فَهُوَ مَا قَالَ رَبُّ السِّلْعَةِ أَوْ يَتَتَارَكَانِ " ،.
Abdur Rahman bin Qais narrates from his father, who conveys this message from his grandfather: Sayyiduna Ash'ath bin Qais bought a slave from among the slaves of khums from Sayyiduna Abdullah for twenty thousand dirhams. Sayyiduna Abdullah sent a message regarding its price, so he (Ash'ath) said: "I bought it for ten thousand dirhams." Then Abdullah said: "Name someone who can decide between you and me." So Sayyiduna Ash'ath said: "You yourself will decide between me and you." Then Sayyiduna Abdullah said: "I heard the Noble Prophet (peace and blessings be upon him) say: When there is a dispute between the two parties of a transaction and neither has any proof, then the statement of the owner of the goods will be accepted, or both should abandon the transaction."
