ثنا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا مُحَمَّدُ بْنُ الْحُسَيْنِ الأَعْرَابِيُّ أَبُو جَعْفَرٍ ، نَا شَاذَانُ ، نَا أَيُّوبُ بْنُ عُتْبَةَ ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ ، عَنْ عَطَاءٍ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعِ الْغَرَرِ " ، قَالَ أَيُّوبُ : فَسَّرَ يَحْيَى بَيْعَ الْغَرَرِ ، قَالَ : إِنَّ مِنَ الْغَرَرِ حُصُولَ الْغَائِصِ ، وَبَيْعُ الْغَرَرِ الْعَبْدُ الآبِقُ ، وَبَيْعُ الْبَعِيرِ الشَّارِدِ ، وَبَيْعُ مَا يَكُونُ فِي بُطُونِ الأَنْعَامِ ، وَبَيْعُ تُرَابِ الْمَعَادِنِ ، وَبَيْعُ مَا فِي ضُرُوعِ الأَنْعَامِ إِلا بِكَيْلٍ.
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) forbade the sale of gharar (uncertainty). The narrator named Ayyub has reported this statement, and the narrator named Yahya has explained the meaning of the sale of gharar. He says: The sale of gharar includes making a deal for whatever the diver brings up after diving, the sale of a runaway slave, or the sale of a runaway camel, or the sale of what is in the wombs of animals, or the sale of whatever comes out from minerals, or the sale of what is in the udders of animals. However, if the sale is for a measured quantity (for example, if that much milk comes out, then the sale will take place), then such a transaction is permissible.
