حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْهَيْثَمِ بْنِ خَالِدٍ الطَّيِّبِيُّ ، نا طَاهِرُ بْنُ خَالِدِ بْنِ نِزَارٍ ، نا أَبِي ، نا إِبْرَاهِيمُ بْنُ طَهْمَانَ ، عَنْ مَطَرٍ الْوَرَّاقِ ، عَنْ مُعَاوِيَةَ بْنِ قُرَّةَ ، عَنْ شَيْخٍ مِنَ الأَنْصَارِ ، أَنَّهُ حَدَّثَهُ أَنَّ رَجُلا كَانَ مُحْرِمًا عَلَى رَاحِلَتِهِ فَأَتَى عَلَى أُدْحِيِّ نَعَامَةٍ ، فَأَصَابَ مِنْ بَيْضِهَا فَسَقَطَ فِي يَدَيْهِ ، فَأَفْتَاهُ عَلِيُّ بْنُ أَبِي طَالِبٍ عَلَيْهِ السَّلامُ أَنْ يَشْتَرِيَ بَنَاتِ مَخَاضٍ فَيَضْرِبُهُنَّ ، فَمَا أَنْتَجَ مِنْهُنَّ أَهْدَاهُ إِلَى الْبَيْتِ وَمَا لَمْ يُنْتِجْ مِنْهُنَّ أَجْزَأَ عَنْهُ ، لأَنَّ الْبِيضَ مِنْهُ مَا يَصْلُحُ وَمِنْهُ مَا يَفْسُدُ ، قَالَ : فَأَتَى الرَّجُلُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ بِمَا أَفْتَاهُ عَلِيُّ بْنُ أَبِي طَالِبٍ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " قَدْ قَالَ عَلِيُّ مَا قَالَ ، فَهَلْ لَكَ فِي الرُّخْصَةِ ؟ " ، قَالَ : نَعَمْ ، قَالَ : " فَإِنَّ فِي كُلِّ بَيْضَةِ نَعَامٍ إِطْعَامُ مِسْكِينٍ أَوْ صَوْمُ يَوْمٍ " .
Muawiyah bin Qurrah narrates from an Ansari elder: A man was traveling on his mount in the state of ihram. He reached near an ostrich’s nest, took an egg from there, but it fell from his hand. So, Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) gave the ruling regarding this that he should buy she-camels that are ready to mate, let them mate, and then whatever offspring they give birth to, that man should offer those offspring as a gift to the House of Allah. And if those she-camels do not give birth to any offspring, even then the man’s expiation will be fulfilled, because sometimes a chick hatches from an egg and sometimes it does not. The narrator states: That man came to the service of the Noble Prophet (peace and blessings be upon him) and informed him about this, that Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) had given him this fatwa. So the Noble Prophet (peace and blessings be upon him) said: “Ali has said what he had to say; do you want some concession?” He replied: “Yes.” The Noble Prophet (peace and blessings be upon him) said: “For each egg, the expiation will be to feed a poor person or to fast one day.”
