Hadith 2257

حَدَّثَنَا حَدَّثَنَا إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ الْفَضْلِ الزَّيَّاتُ ، ثنا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الْمُخَرِّمِيُّ ، ثنا يَحْيَى بْنُ سَعِيدٍ ، عَنْ سَيْفِ بْنِ سُلَيْمَانَ ، قَالَ : سَمِعْتُ قَيْسَ بْنَ سَعْدٍ ، حَدَّثَنِي دَاوُدُ بْنُ أَبِي عَاصِمٍ ، سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ ، أَنَّ عُمَرَ خَرَجَ عَلَى أَصْحَابِهِ ، فَقَالَ : مَا تَرَوْنَ فِي شَيْءٍ صَنَعْتُ الْيَوْمَ ؟ أَصْبَحْتُ صَائِمًا ، فَمَرَّتْ بِي جَارِيَةٌ فَأَعْجَبَتْنِي ، فَأَصَبْتُ مِنْهَا ، فَعَظَّمَ الْقَوْمُ عَلَيْهِ مَا صَنَعَ ، وَعَلِيُّ رَضِيَ اللَّهُ عَنْهُ سَاكِتٌ ، فَقَالَ : مَا تَقُولُ ؟ قَالَ : " أَتَيْتَ حَلالا ، وَيَوْمٌ مَكَانَ يَوْمٍ " ، قَالَ : أَنْتَ خَيْرُهُمْ فُتْيَا .
Dawud bin Abu Asim narrates: He heard Sa'id bin al-Musayyib saying: Once, Sayyiduna Umar (may Allah be pleased with him) came to his companions and asked: What do people think about what I did today? In the morning I was fasting, then a slave girl passed by me, I liked her, so I had intercourse with her. The people considered this act of his to be very wrong, while Sayyiduna Ali (may Allah be pleased with him) remained silent. Sayyiduna Umar (may Allah be pleased with him) asked: What do you say? He replied: You have committed a lawful act, and in exchange for this day, keep a fast on another day. So Sayyiduna Umar (may Allah be pleased with him) said: You have given a better fatwa than all of them.
