بَابُ الشَّهَادَةِ عَلَى رُؤْيَةِ الْهِلَالِChapter on testimony for sighting the crescent

حَدَّثَنَا حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، ثنا حَاجِبُ بْنُ سُلَيْمَانَ ، ثنا مُؤَمَّلُ بْنُ إِسْمَاعِيلَ ، حَدَّثَنَا سُفْيَانُ ، حَدَّثَنِي مَنْصُورٌ ، عَنْ أَبِي وَائِلٍ ، قَالَ : " جَاءَنَا كِتَابُ عُمَرَ وَنَحْنُ بِخَانِقِينَ : إِنَّ الأَهِلَّةَ بَعْضُهَا أَعْظَمُ مِنْ بَعْضٍ ، فَإِذَا رَأَيْتُمُ الْهِلالَ لأَوَّلِ النَّهَارِ فَلا تُفْطِرُوا حَتَّى يَشْهَدَ رَجُلانِ ذَوَا عَدْلٍ أَنَّهُمَا أَهَلاهُ بِالأَمْسِ عَشِيَّةً " . قَالَ لَنَا أَبُو بَكْرٍ : إِنْ كَانَ مُؤَمَّلٌ حَفِظَهُ فَهُوَ غَرِيبٌ ، وَخَالَفَهُ الإِمَامُ عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ.
Abu Wa'il narrates: A letter from Sayyiduna Umar (may Allah be pleased with him) came to us while we were at the place of Khanqin (in which it was written): "The crescent of the first (of the month) sometimes appears small or large, so when you see the moon in the early part of the day, do not celebrate Eid until two just men testify that they saw the moon the previous night." Abu Bakr has narrated this: If the narrator named Mumil, this narration is rare, because Imam Abdur Rahman Mahdi has narrated it differently from him.
