Hadith 3275
حَدَّثَنَا حَدَّثَنَا
أَبُو النُّعْمَانِ، حَدَّثَنَا
هُشَيْمٌ، أَنْبَأَنَا
مَنْصُورٌ، عَنِ
الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ:
"إِذَا أَوْصَى الرَّجُلُ إِلَى الرَّجُلِ وَهُوَ غَائِبٌ، فَلْيَقْبَلْ وَصِيَّتَهُ، وَإِنْ كَانَ حَاضِرًا، فَهُوَ بِالْخِيَارِ: إِنْ شَاءَ، قَبِلَ، وَإِنْ شَاء، َتَرَكَ".
Hasan (may Allah have mercy on him) used to say: If a man makes a bequest for someone who is absent, then he (the legatee) should accept that bequest, and if he (the legatee) is present, then he has the choice—if he wishes, he may accept it, and if he wishes, he may leave it.
Hadith 3276
حَدَّثَنَا صَالِحُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، قَالَ: سَأَلْتُ الْحَسَنَ، وَمُحَمَّدًا عَنِ"الرَّجُلِ يُوصِي إِلَى الرَّجُلِ، قَالَا: نَخْتَارُ أَنْ يَقْبَلَ".
It is narrated from Ayyub (as-Sakhtiyani) that I asked Hasan and Muhammad, may Allah have mercy on them: If a person makes a bequest for someone, then what? Both said: He should accept the bequest.
Hadith 3277
Hasan (may Allah have mercy on him) said: If a man makes a bequest to an absent person and he accepts it, then he will no longer have the option to reject it.
Hadith 3278
Hasan (may Allah have mercy on him) said: When a man makes a bequest for someone and that person is not present, then if the bequest is presented to him (the legatee) and he accepts it, the one who made the bequest no longer has the right to revoke it.
