Sunan ad-Darimi
من كتاب الوصاياFrom the Book of Wills
باب في الذي يُوصِي لِبَنِي فُلاَنٍ بِسْهَمٍ مِنْ مَالِهِ:
Chapter on someone who bequeaths a share to the children of so-and-so
Hadith 3265
أَخْبَرَنَا أَخْبَرَنَا الْمُعَلَّى بْنُ أَسَدٍ، قَالَ: حَدَّثَنَا وُهَيْبٌ، عَنْ يُونُسَ، عَنْ الْحَسَنِ: "فِي الرَّجُلِ يُوصِي لِبَنِي فُلَانٍ، قَالَ: غَنِيُّهُمْ وَفَقِيرُهُمْ وَذَكَرُهُمْ وَأُنْثَاهُمْ سَوَاءٌ".
Hasan (may Allah have mercy on him) said: If a man makes a bequest for someone’s children, then in that bequest, the wealthy, the needy, the men, and the women will all be equal. That is, all will be given an equal share from the one-third.
Hadith 3266
حَدَّثَنَا حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، عَنْ عَمْرٍو، عَنْ الْحَسَنِ، قَالَ: "إِذَا أَوْصَى لِبَنِي فُلَانٍ، فَالذَّكَرُ وَالْأُنْثَى فِيهِ سَوَاءٌ".
Hasan (may Allah have mercy on him) said: If a man makes a bequest for someone’s children, then both males and females will be equal in it.
Hadith 3267
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا زَائِدَةُ بْنُ مُوسَى الْهَمْدَانِيُّ، حَدَّثَنِي سَيَّارُ بْنُ أَبِي كَرِبٍ: "أَنَّ آتِيًا أَتَى شُرَيْحًا، فَسَأَلَهُ عَنْ رَجُلٍ أَوْصَى بِسَهْمٍ مِنْ مَالِهِ، قَالَ: تُحْسَبُ الْفَرِيضَةُ، فَمَا بَلَغَ سِهَامَهَا، أُعْطِيَ الْمُوصَى لَهُ سَهْمًا كَأَحَدِهَا".
Siyar bin Abi Karib narrated that a man came to Qadi Shurayh and asked: If a man makes a bequest of a portion of his wealth, he (Shurayh) said: This will be included in the obligatory shares; out of however many shares there are, the one portion for which the bequest is made will also be given to him just like the other shares.
