Hadith 3253
أخبرنا مَرْوَانُ بْنُ مُحَمَّدٍ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ، حَدَّثَنَا النُّعْمَانُ بْنُ الْمُنْذِرِ، عَنْ مَكْحُولٍ، قَالَ: "إِذَا كَانَ الْوَرَثَةُ مَحَاوِيجَ، فَلَا أَرَى بَأْسًا أَنْ يُرَدَّ عَلَيْهِمْ مِنْ الثُّلُثِ"، قَالَ يَحْيَى: فَذَكَرْتُ ذَلِكَ لِلْأَوْزَاعِيِّ فَأَعْجَبَهُ.
Makhul (may Allah have mercy on him) said: If the heirs (of the deceased) are in need, then in my opinion there is no harm in giving them a share from the third of the wealth. Yahya said: I mentioned this to Awza'i (may Allah have mercy on him), and he liked this opinion.
