Hadith 3249
حَدَّثَنَا أَبُو الْوَلِيدِ، حَدَّثَنَا شَرِيكٌ، عَنْ الشَّيْبَانِيِّ، عَنْ عَامِرٍ، قَالَ: "يَجُوزُ بَيْعُ الْمَرِيضِ وَشِرَاؤُهُ وَنِكَاحُهُ، وَلَا يَكُونُ مِنَ الثُّلُثِ".
It is narrated from Aamir (Sha'bi, may Allah have mercy on him), he said: It is permissible for a sick person to buy and sell and to marry, and this will not be counted from the one-third.
Hadith 3250
حَدَّثَنَا أَبُو الْوَلِيدِ، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ مُطَرِّفٍ، عَنْ الْحَارِثِ الْعُكْلِيِّ، قَالَ: "مَا حَابَى بِهِ الْمَرِيضُ فِي مَرَضِهِ مِنْ بَيْعٍ أَوْ شِرَاءٍ، فَهُوَ فِي ثُلُثِهِ قِيمَةُ عَدْلٍ".
Harith Akli said: If a sick person buys or sells during his illness, then it will be from one third of his wealth, with a fair price.
Hadith 3251
حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ يَحْيَى هُوَ ابْنُ سَعِيدٍ، قَالَ: أَعْطَتِ امْرَأَةٌ مِنْ أَهْلِنَا وَهِيَ حَامِلٌ، فَسُئِلَ الْقَاسِمُ، فَقَالَ: "هُوَ مِنْ جَمِيعِ الْمَالِ، قَالَ يَحْيَى: وَنَحْنُ نَقُولُ: إِذَا ضَرَبَهَا الْمَخَاضُ فَمَا أَعْطَتْ، فَمِنْ الثُّلُثِ".
Yahya bin Saeed said: A woman from our family gave a gift while she was pregnant. Qasim (ibn Muhammad, may Allah have mercy on him) was asked about this, and he said: The gift will be taken from the whole wealth. And Yahya said: We say that if she gave the gift when the labor pains had started, then it will be taken from one third of the wealth.
Hadith 3252
حَدَّثَنَا حَدَّثَنَا
أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا
أَبُو شِهَابٍ، عَنْ
عَمْرٍو، عَنْ
الْحَسَنِ: "فِي رَجُلٍ قَالَ لِغُلَامِهِ: إِنْ دَخَلْتُ دَارَ فُلَانٍ، فَغُلَامِي حُرٌّ، ثُمَّ دَخَلَهَا وَهُوَ مَرِيضٌ، قَالَ:
يُعْتَقُ مِنْ الثُّلُثِ، وَإِنْ دَخَلَ فِي صِحَّتِهِ، عُتِقَ مِنْ جَمِيعِ الْمَالِ".
Hasan (may Allah have mercy on him) was asked about a person who said to his slave: "If I enter so-and-so's house, then my slave is free." Then he entered that house while he was ill. Hasan (may Allah have mercy on him) said: He will be freed from one third of the wealth, and if he entered that house while he was healthy, then he will be freed from the entire wealth.
