Hadith 3242
حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ، حَدَّثَنَا زَائِدَةُ، عَنْ الشَّيْبَانِيِّ، عَنْ الشَّعْبِيِّ، قَالَ: "يُغَيِّرُ صَاحِبُ الْوَصِيَّةِ مِنْهَا مَا شَاءَ، غَيْرَ الْعَتَاقَةِ".
It is narrated from al-Shaybani (Sulaiman bin Abi Sulaiman): Imam Sha'bi, may Allah have mercy on him, said: The one making a bequest may alter whatever he wishes in the bequest except for emancipation (in that, there can be no alteration).
Hadith 3243
It is narrated from Abdullah bin Abi Rabiah that Sayyiduna Umar bin Al-Khattab, may Allah be pleased with him, said: A man can add whatever he wishes to his will, and whichever is the last will, that will be the original one.
Hadith 3244
حَدَّثَنَا سَهْلُ بْنُ حَمَّادٍ، حَدَّثَنَا هَمَّامٌ، قَالَ: حَدَّثَنِي قَتَادَةُ، قَالَ: حَدَّثَنِي عَمْرُو بْنُ دِينَارٍ: "أَنَّ أَبَاهُ أَعْتَقَ رَقِيقًا لَهُ فِي مَرَضِهِ، ثُمَّ بَدَا لَهُ أَنْ يَرُدَّهُمْ وَيُعْتِقَ غَيْرَهُمْ، قَالَ: فَخَاصَمُونِي إِلَى عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ، فَأَجَازَ عِتْقَ الْآخِرِينَ، وَأَبْطَلَ عِتْقَ الْأَوَّلِينَ".
Amr bin Dinar narrated that his father freed his slave during his illness, then he felt that he should take him back (i.e., not free him) and free other slaves instead. So those slaves disputed with me before Abdul Malik bin Marwan, and Abdul Malik validated the freedom of the latter group and annulled the freedom of the former.
Hadith 3245
It is narrated from Shureid bin Suwaid that Sayyiduna Umar (may Allah be pleased with him) said: A man can make whatever (changes or) additions he wishes in his will, and the last will is the original one. Imam Darimi (may Allah have mercy on him) said: Hammam did not hear from Amr bin Shu'aib, and between the two of them is Qatadah (may Allah have mercy on him).
Hadith 3246
حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ، قَالَ: ابْنُ الْمُبَارَكِ حَدَّثَنَا، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ: "فِي الرَّجُلِ يُوصِي بِوَصِيَّةٍ ثُمَّ يُوصِي بِأُخْرَى، قَالَ: هُمَا جَائِزَتَانِ فِي مَالِهِ".
It is narrated from Mu'ammar that Imam Zuhri, may Allah have mercy on him, was asked about a person who makes a will, then makes another will? Zuhri, may Allah have mercy on him, said: Both wills are permissible regarding his wealth (i.e., he has the right to change them).
Hadith 3247
It is narrated from Qatadah (may Allah have mercy on him) that Sayyiduna Umar (may Allah be pleased with him) said: The last will is the real one.
