Hadith 3235
حَدَّثَنَا أَبُو الْوَلِيدِ، حَدَّثَنَا شَرِيكٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: "الْوَصِيُّ أَمِينٌ فِيمَا أُوصِيَ إِلَيْهِ بِهِ".
It is narrated from Mughira: Ibrahim (may Allah have mercy on him) said: The executor is the trustee of that which is bequeathed to him.
Hadith 3236
حَدَّثَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ، عَنْ أبي وَهْبٍ، عَنْ مَكْحُولٍ، قَالَ: "أَمْرُ الْوَصِيِّ جَائِزٌ فِي كُلِّ شَيْءٍ، إِلَّا فِي الِابْتِيَاعِ، وَإِذَا بَاعَ بَيْعًا لَمْ يُقِلْ"، وَهُوَ رَأْيُ يَحْيَى بْنِ حَمْزَةَ.
It is narrated from Abu Wahb that Mak'hool (may Allah have mercy on him) said: The matter of the executor (wasiyy) is permissible in everything except a house, shop, or land; if he sells anything, it will not be revoked. This is also the opinion of Yahya bin Hamzah.
Hadith 3237
حَدَّثَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ، حَدَّثَنَا الْوَلِيدُ، عَنْ الْأَوْزَاعِيِّ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، قَالَ: "الْوَصِيُّ أَمِينٌ فِي كُلِّ شَيْءٍ، إِلَّا فِي الْعِتْقِ، فَإِنَّ عَلَيْهِ أَنْ يُقِيمَ الْوَلَاءَ".
Yahya bin Abi Kathir said: The executor is a trustee over everything except freeing a slave, and he can establish wala (clientship).
Hadith 3238
حَدَّثَنَا عُبَيْدُ اللَّهِ، عَنْ إِسْرَائِيلَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ: "فِي مَالِ الْيَتِيمِ يَعْمَلُ بِهِ الْوَصِيُّ إِذَا أَوْصَى إِلَى الرَّجُلِ".
It is narrated from Mansur (ibn al-Mu'tamir): Ibrahim (may Allah have mercy on him) said: The guardian (executor) will conduct business (such as trade, etc.) with the wealth of the orphan when someone has made a bequest to him.
Hadith 3239
It is narrated from Ismail that Hasan (may Allah have mercy on him) said: The guardian of an orphan will take the right of pre-emption (shuf‘a) for him, and the guardian of an absent person, to whom the right of pre-emption has been bequeathed, will also take the right of pre-emption.
Hadith 3240
أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ، عَنْ عِكْرِمَةَ شَيْخٍ مِنْ أَهْلِ دِمَشْقَ، قَالَ: "كُنْتُ عِنْدَ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، وَعِنْدَهُ سُلَيْمَانُ بْنُ حَبِيبٍ، وَأَبُو قِلَابَةَ، إِذْ دَخَلَ غُلَامٌ، فَقَالَ: أَرْضُنَا بِمَكَانِ كَذَا وَكَذَا، بَاعَكُمْ الْوَصِيُّ وَنَحْنُ أَطْفَالٌ، فَالْتَفَتَ إِلَى سُلَيْمَانَ بْنِ حَبِيبٍ، فَقَالَ: مَا تَقُولُ ؟ قَالَ: فَأَضْجَعَ فِي الْقَوْلِ، فَالْتَفَتَ إِلَى أَبِي قِلَابَةَ، فَقَالَ: مَا تَقُولُ ؟ قَالَ: رُدَّ عَلَى الْغُلَامِ أَرْضَهُ، قَالَ: إِذًا يَهْلِكُ مَالُنَا ؟ قَالَ: أَنْتَ أَهْلَكْتَهُ".
Ikrimah narrated: A sheikh from Damascus said: I was with Umar bin Abdul Aziz, may Allah have mercy on him, and with him were Sulaiman bin Habib and Abu Qilabah, when suddenly a boy came and said: Such-and-such place is our land which our guardian sold to you when we were children. Umar bin Abdul Aziz, may Allah have mercy on him, turned to Sulaiman bin Habib and said: What do you say about this? He gave an evasive answer. Then he turned to Abu Qilabah and said: What do you say? He said: Return the boy’s land. He said: Then our wealth will be lost. He replied: You yourself have wasted your wealth.
