باب الرَّجُلِ يَمُوتُ وَلاَ يَدَعُ عَصَبَةً:
Chapter on a man who dies leaving no agnatic heirs
Hadith 3207
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يَزِيدَ، حَدَّثَنَا حَيْوَةُ، أَخْبَرَنِي سَهْمُ بْنُ يَزِيدَ الْحَمْرَاوِيُّ: "أَنَّ رَجُلًا تُوُفِّيَ وَلَيْسَ لَهُ وَارِثٌ، فَكُتِبَ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَهُوَ خَلِيفَةٌ، فَكَتَبَ: أَنْ اقْتَسِمُوا مِيرَاثَهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمْ الْعَطَاءَ، فَقُسِمَ مِيرَاثُهُ عَلَى مَنْ كَانَ يَأْخُذُ مَعَهُمْ الْعَطَاءَ فِي عِرَافَتِهِ".
Sahm bin Yazid Hamrawi reported that a man died and left no heirs. They wrote about this to Umar bin Abdul Aziz, may Allah have mercy on him, who was the caliph at that time. He replied that his inheritance should be given to those who used to receive stipends with him. So, under his supervision, his inheritance was distributed among those who used to receive stipends with him.
