Hadith 3197
It is narrated from Imam Sha'bi (may Allah have mercy on him) that Sayyiduna Ali, Sayyiduna Umar, and Sayyiduna Zaid (may Allah be pleased with them) said: The father will draw the wala’ (allegiance) of his son towards himself.
Hadith 3198
حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ أَشْعَثَ، عَنْ الشَّعْبِيِّ، قَالَ: "الْجَدُّ يَجُرُّ الْوَلَاءَ".
Shu'bi, may Allah have mercy on him, said: The grandfather will take the wala'.
Hadith 3199
حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ أَشْعَثَ، عَنْ ابْنِ سِيرِينَ، عَنْ شُرَيْحٍ، قَالَ: "الْوَالِدُ يَجُرُّ وَلَاءَ وَلَدِهِ".
It is narrated from Muhammad bin Sirin, may Allah have mercy on him, that Qadi Shurayh said: A father will take the wala’ (allegiance/freedom) of his son.
Hadith 3200
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا زَكَرِيَّا، عَنْ عَامِرٍ: "فِي مَمْلُوكٍ تُوُفِّيَ وَلَهُ أَبٌ حُرٌّ، وَلَهُ بَنُونَ مِنْ امْرَأَةٍ حُرَّةٍ، لِمَنْ وَلَاءُ وَلَدِهِ ؟ قَالَ: لِمَوَالِي الْجَدِّ".
It is narrated from Imam Amir Sha'bi, may Allah have mercy on him: A slave died and his free father and his sons (i.e., the deceased's sons) from a free woman are present. So, for whom will the wala' (right of inheritance/freedom) be? He said: In such a case, the wala' will belong to those who own the grandfather.
Hadith 3201
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا إِسْرَائِيلُ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ: "فِي مُكَاتَبٍ مَاتَ وَقَدْ أَدَّى نِصْفَ مُكَاتَبَتِهِ، وَلَهُ وَلَدٌ مِنْ امْرَأَةٍ حُرَةٍ، قَالَ: مَا أُرَاهُ إِلَّا قَدْ جَرَّ وَلَاءَ وَلَدِهِ".
It is narrated from Mughira: Ibrahim (may Allah have mercy on him) said: A slave who was a mukatab died, having paid half of his installments, and he had a son from a free wife. He (Ibrahim) said: I think he (the master) will claim the wala’ of his son.
Hadith 3202
حَدَّثَنَا حَدَّثَنَا
سُلَيْمَانُ بْنُ حَرْبٍ، حَدَّثَنَا
شُعْبَةُ، عَنْ
الْحَكَمِ، عَنْ
إِبْرَاهِيمَ، قَالَ: "كَانَ شُرَيْحٌ لَا يَرْجِعُ عَنْ قَضَاءٍ يَقْضِي بِهِ، فَحَدَّثَهُ
الْأَسْوَدُ: أَنَّ
عُمَرَ، قَالَ:
إِذَا تَزَوَّجَ الْمَمْلُوكُ الْحُرَّةَ، فَوَلَدَتْ أَوْلَادًا أَحْرَارًا، ثُمَّ عُتِقَ بَعْدَ ذَلِكَ، رَجَعَ الْوَلَاءُ لِمَوَالِي أَبِيهِمْ"، فَأَخَذَ بِهِ شُرَيْحٌ.
It is narrated from Hakam that Ibrahim (may Allah have mercy on him) said: Judge Shurayh would not retract any decision he made. Aswad narrated from him that Sayyiduna Umar (may Allah be pleased with him) said: When a slave marries a free woman, and then children are born from the woman who are free, and later the father also becomes free, then the right of wala’ (allegiance) is given to those who freed their father. Thus, Judge Shurayh accepted this.
Hadith 3203
حَدَّثَنَا حَدَّثَنَا
يَعْلَى، عَنْ
الْأَعْمَشِ، عَنْ
إِبْرَاهِيمَ، قَالَ: قَالَ
عُمَر: "الْمَمْلُوكِ يَكُونُ تَحْتَهُ الْحُرَّةُ،
يُعْتَقُ الْوَلَدُ بِعِتْقِ أُمِّهِ، فَإِذَا عُتِقَ الْأَبُ، جَرَّ الْوَلَاءَ".
It is narrated from Ibrahim, may Allah have mercy on him, that Sayyiduna Umar, may Allah be pleased with him, said: If a slave is married to a free woman, then his son will also be free along with his mother, and when the father is set free, he will draw the wala’ (right of allegiance) to himself.
Hadith 3204
حَدَّثَنَا مُسْلِمٌ، حَدَّثَنَا عَبْدُ الْوَارِثِ، عَنْ كَثِيرِ بْنِ شِنْظِيرٍ، عَنْ عَطَاءٍ: "فِي الْحُرَّةِ تَحْتَ الْعَبْدِ، قَالَ: أَمَّا مَا وَلَدَتْ مِنْهُ وَهُوَ عَبْدٌ، فَوَلَاؤُهُمْ لِأَهْلِ نِعْمَتِهَا، وَمَا وَلَدَتْ مِنْهُ وَهُوَ حُرٌّ، فَوَلَاؤُهُمْ لِأَهْلِ نِعْمَتِهِ".
It is narrated from Ata regarding a free woman who is married to a slave: The children born to her during the period of slavery, their wala’ (allegiance) will be for the benefactors of the woman, and the children born after the slave’s emancipation, their wala’ will be for the benefactors (those who granted freedom) of the slave.
Hadith 3205
حَدَّثَنَا حَدَّثَنَا
جَعْفَرُ بْنُ عَوْنٍ، عَنْ
الْأَعْمَشِ، عَنْ
إِبْرَاهِيمَ، قَالَ: قَالَ
عُمَرُ:
"إِذَا كَانَتْ الْحُرَّةُ تَحْتَ الْمَمْلُوكِ، فَوَلَدَتْ لَهُ غُلَامًا، فَإِنَّهُ يُعْتَقُ بِعِتْقِ أُمِّهِ، وَوَلَاؤُهُ لِمَوَالِي أُمِّهِ، فَإِذَا أُعْتِقَ الْأَبُ، جَرَّ الْوَلَاءَ إِلَى مَوَالِي أَبِيهِ".
It is narrated from Ibrahim, may Allah have mercy on him, that Sayyiduna Umar, may Allah be pleased with him, said: If a free woman is married to a slave and a boy is born from this slave, then with the freedom of his mother, the boy will also be set free, and his wala’ (right of allegiance) will be for the owners of his mother. Then, when the slave is freed, his wala’ will transfer to the mawali (clients) of his father.
Hadith 3206
حَدَّثَنَا حَدَّثَنَا
الْحَكَمُ بْنُ الْمُبَارَكِ، حَدَّثَنَا
مُحَمَّدُ بْنُ سَلَمَةَ، عَنْ
ابْنِ إِسْحَاق، عَنْ
الْعَلَاءِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ
أَبِيهِ، قَالَ:
"كَانَتْ أُمِّي مَوْلَاةً لِلْحُرَقَةِ، وَكَانَ أَبِي يَعْقُوبُ مُكَاتَبًا لِمَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ النَّصْرِيِّ، ثُمَّ إِنَّ أَبِي أَدَّى كِتَابَتَهُ، فَدَخَلَ الْحُرَقِيُّ عَلَى عُثْمَانَ، يَسْأَلُ الْحَقَّ يَعْنِي: الْعَطَاءَ، وَعِنْدَهُ مَالِكُ بْنُ أَوْسٍ، فَقَالَ: ذَاكَ مَوْلَايَ، فَاخْتَصَمَا إِلَى عُثْمَانَ، فَقَضَى بِهِ لِلْحُرَقِيِّ".
It is narrated from Alaa bin Abdur Rahman, from his father, who said: My mother was a freed slave woman of the tribe of Harqah, and my father, Yaqub, was a mukatab (contracted slave) of Malik bin Aws bin Hadthan Nasri. Then my father paid the agreed amount for his manumission. So a man from Harqah came to Uthman (may Allah be pleased with him), and at that time Aws bin Malik was also sitting with him. The man from Harqah claimed my right, meaning the right of wala’ (allegiance/gift), and said: "He is my freed slave." Both of them sought a judgment from Uthman (may Allah be pleased with him), so he ruled in favor of the man from Harqah, that is, he ruled in favor of the mawali (clients) of the mother, not the mawali of the father.
