Hadith 3171
حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا هُشَيْمٌ، أنبأنا يُونُسُ، عَنْ الْحَسَنِ . ح وحَدَّثَنَا جَرِيرٌ، عَنْ أَبَانَ بْنِ تَغْلِبَ، عَنْ الْحَكَمِ، عَنْ إِبْرَاهِيمَ، أَنَّهُمَا قَالَا: "إِنْ ضَمِنَ، كَانَ الْوَلَاءُ لَهُ، وَإِنْ اسْتَسْعَى الْعَبْدُ، كَانَ الْوَلَاءُ بَيْنَهُمْ".
It is narrated from Aban bin Taghlib, Hakam and Abu Nu'aim said: If someone becomes a guarantor, then the right of wala' will be his. And if a slave is made to work for his freedom, then the right of inheritance will be divided among the owners.
Hadith 3172
حَدَّثَنَا يَعْلَى، وَأَبُو نُعَيْمٍ، قَالَا: حَدَّثَنَا زَكَرِيَّا، عَنْ عَامِرٍ: فِي عَبْدٍ بَيْنَ رَجُلَيْنِ أَعْتَقَ أَحَدُهُمَا نَصِيبَهُ، فَقَالَ: "يُتَمَّمُ عِتْقُهُ، فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ، اسْتُسْعِيَ الْعَبْدُ فِي النِّصْفِ بِقِيمَةِ عَدْلٍ، وَالْوَلَاءُ لِمَنْ أَعْتَقَ".
It is narrated from ‘Amir (Sha‘bi), may Allah have mercy on him, regarding a slave who is owned between two owners, and one owner frees his share: Sha‘bi, may Allah have mercy on him, said: His freedom will be completed; if he does not have wealth, then he will work to pay for the remaining half, and the right of inheritance (wala’) will belong to the one who set him free.
Hadith 3173
حَدَّثَنَا هَارُونُ بْنُ مُعَاوِيَةَ، عَنْ أَبِي سُفْيَانَ الْمَعْمَرِيِّ، عَنْ مَعْمَرٍ، عَنْ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ: فِي عَبْدٍ بَيْنَ رَجُلَيْنِ، أَعْتَقَ أَحَدَهُمَا نَصِيبَهُ وَأَمْسَكَهُ الْآخَرُ، قَالَ: "مِيرَاثُهُ بَيْنَهُمَا".
Ibn Tawus narrated from his father: If a slave is owned between two men (i.e., is the slave of two people), and one of them frees his share while the other withholds, Tawus (may Allah have mercy on him) said: His inheritance will be divided between both (owners).
Hadith 3174
حَدَّثَنَا هَارُونُ، عَنْ أَبِي سُفْيَانَ، عَنْ مَعْمَرٍ، عَنْ الزُّهْرِيِّ، قَالَ: "مِيرَاثُهُ لِلَّذِي أَمْسَكَهُ . وقال قَتَادَةُ: هُوَ لِلْمُعْتِقِ كُلُّهُ، وَثَمَنُهُ عَلَيْهِ، وَيَقُولُهُ أَهْلُ الْكُوفَةِ.
Imam Zuhri, may Allah have mercy on him, said: His inheritance will go to the one who has withheld his share, and it is entirely for the emancipator, and the remaining price is also due upon the emancipator. The people of Kufa say the same.
