Hadith 3169
حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، عَنْ الشَّيْبَانِيِّ، عَنْ الشَّعْبِيِّ: فِي الْعَبْدِ يَتَزَوَّجُ الْمَرْأَةَ، ثُمَّ يُطَلِّقُهَا وَلَهُ مِنْهَا وَلَدٌ ؟ قَالَ: "إِنْ كَانَتْ حُرَّةً، فَالنَّفَقَةُ عَلَى أُمِّهِ، وَإِنْ كَانَ عَبْدًا، يَعْنِي: الصَّبِيَّ، فَعَلَى مُوَالِيهِ".
It is narrated from Shaibani (Sulaiman bin Firoz): Sha'bi (may Allah have mercy on him) said: If a slave marries a woman and a boy is born from her, then if the woman is free, the maintenance (expenses) will be the responsibility of the mother (not the slave father), and if the boy is also a slave, then his expenses will be upon his masters.
Hadith 3170
حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا هُشَيْمٌ، حَدَّثَنَا زَكَرِيَّا، عَنْ عَامِرٍ . ح وحَدَّثَنَا جَرِيرٌ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ: أَنَّهُمَا قَالَا: "وَلَاؤُهُ لِمَنْ بَدَأَ بِالْعِتْقِ أَوَّلَ مَرَّةٍ".
Imam Amir Sha'bi and Ibrahim, may Allah have mercy on them, said: The right of inheritance will belong to the one who first initiated the emancipation.
