Hadith 3150
Abu Amr al-Shaibani said: Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: A freed slave may dispose of his wealth wherever he wishes. Abdullah bin Zaid said: Shu'bah (may Allah have mercy on him) said: No one heard this from Salamah bin Kuhail except me.
Hadith 3151
It is narrated from Yunus that Hasan (may Allah have mercy on him) was asked about the inheritance of a freed slave. He replied: Every freed slave is a Saibah (i.e., his inheritance belongs to the one who set him free).
Hadith 3152
Abu Uthman said: Sayyiduna Umar (may Allah be pleased with him) said: Charity (sadaqah) and a freed slave (saibah) are both for their (appointed) day.
Hadith 3153
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا زَكَرِيَّا، قَالَ: سُئِلَ عَامِرٍ عَنْ الْمَمْلُوكِ يُعْتَقُ سَائِبَةً لِمَنْ وَلَاؤُهُ ؟ قَالَ: "لِلَّذِي أَعْتَقَهُ".
Zakariya said: ‘Amir (al-Sha‘bi), may Allah have mercy on him, was asked: If a slave is freed as a Sa’ibah (set free without any condition), then to whom does his Wala’ (right of inheritance) belong? He replied: To the one who set him free.
Hadith 3154
Abdur Rahman bin Amr said: During the time of Sayyiduna Uthman (may Allah be pleased with him), a slave died who had no guardian or heir. Sayyiduna Uthman (may Allah be pleased with him) ordered that his wealth be deposited into the Bayt al-Mal (public treasury).
Hadith 3155
حَدَّثَنَا يَعْلَى، حَدَّثَنَا إِسْمَاعِيل، عَنْ عَامِرٍ، عَنْ مَسْرُوقٍ: فِي رَجُلٍ مَاتَ وَلَمْ يَكُنْ لَهُ مَوْلَى عَتَاقَةٍ، قَالَ: "مَالُهُ حَيْثُ أَوْصَى بِهِ، فَإِنْ لَمْ يَكُنْ أَوْصَى، فَهُوَ فِي بَيْتِ الْمَالِ".
It is narrated from ‘Amir (Sha‘bi), may Allah have mercy on him, that Masruq, may Allah have mercy on him, said: If a man dies and he has no freedman as his guardian, then his wealth should be spent as he has bequeathed. And if he has not made a bequest, then that wealth should be deposited in the public treasury (Bayt al-Mal).
Hadith 3156
حَدَّثَنَا أَبُو سَعِيدِ بْنُ عَمْرٍو، عَنْ أَبِي بَكْرِ بْنِ أَبِي مَرْيَمَ، عَنْ ضَمْرَةَ، وَرَاشِدِ بْنِ سَعْدٍ، وَغَيْرِهِمَا، قَالُوا فِيمَنْ أُعْتِقَ سَائِبَةً: "إِنَّ وَلَاءَهُ لِمَنْ أَعْتَقَهُ، إِنَّمَا سَيَّبَهُ مِنْ الرِّقِّ، وَلَمْ يُسَيِّبْهُ مِنْ الْوَلَاءِ".
It is narrated from Abu Bakr bin Abi Maryam, that Dumrah and Rashid bin Sa’d and others said regarding a person who frees someone as a Saibah, that the wala’ (right of inheritance/loyalty) belongs to the one who freed him, because he freed him from slavery, he did not free him from the wala’ (right of inheritance).
Hadith 3157
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو دَاوُدَ، عَنْ شُعْبَةَ، قَالَ: أَخْبَرَنِي مَنْصُورٌ، عَنْ إِبْرَاهِيمَ، وَالشَّعْبِيِّ، قَالَا: "لَا بَأْسَ بِبَيْعِ وَلَاءِ السَّائِبَةِ وَهِبَتِهِ".
Mansur reported, Ibrahim and Shabi (may Allah have mercy on them both) said: There is no harm in selling the wala’ and gift of Saibah.
Hadith 3158
حَدَّثَنَا حَدَّثَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
الْمَسْعُودِيُّ، عَنْ
الْقَاسِمِ، قَالَ: "أَعْتَقَ رَجُلٌ غُلَامًا سَائِبَةً، فَأَتَى
عَبْدَ اللَّهِ، وَقَالَ: إِنِّي أَعْتَقْتُ غُلَامًا لِي سَائِبَةً، وَهَذِهِ تَرِكَتُهُ، قَالَ: هِيَ لَكَ، قَالَ:
لَا حَاجَةَ لِي فِيهَا، قَالَ: فَضَعْهَا، فَإِنَّ هَهُنَا وَارِثًا كَثِيرًا".
Qasim said: A man freed a slave as a Sa’ibah and came to Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) and said: I have freed my slave as a Sa’ibah and this is his property (inheritance)? Sayyiduna Ibn Mas’ud (may Allah be pleased with him) said: This is for you (i.e., it is your right). He said: I have no need of it. He replied: Keep it, there are many heirs here.
