Hadith 3128
Shu’bi (may Allah have mercy on him) said: Sayyiduna ‘Umar ibn al-Khattab (may Allah be pleased with him) wrote to Judge Shurayh that without evidence (bayyinah), do not make the carrier (hameel) an heir, even if a woman brings him wrapped in rags.
Hadith 3129
أَخْبَرَنَا عُبَيْدُ اللَّهِ، عَنْ إِسْرَائِيلَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، قَالَ: "وَرِّثْ الْحَمِيلَ".
It is narrated from Mansur that Ibrahim (may Allah have mercy on him) said: The hamil (the child carried and brought forth) will be an heir.
Hadith 3130
حَدَّثَنَا أَبُو سَعِيدٍ مِنْ بَنِي أُمَيَّةَ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي مَرْيَمَ، عَنْ ضَمْرَةَ، وَالْفُضَيْلِ بْنِ فَضَالَةَ، وَابْنِ أَبِي عَوْفٍ، وراشد، وعطية، قَالُوا: "لَا يُوَرَّثُ الْحُمَلَاءُ".
It is narrated from Abu Bakr bin Abdullah bin Abi Maryam: Zumrah, Fudail bin Fudalah, Ibn Abi Awf, Rashid, and Atiyyah all said: The Hamīl will not be heirs.
Hadith 3131
حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ، قَالَ: قَالَ ابْنُ الْمُبَارَكِ: حَدَّثَنَا ابْنُ عَوْنٍ، عَنْ مُحَمَّدٍ، قَالَ: ذُكِرَ عِنْدَهُ قَوْلُ مَنْ يَقُولُ فِي الْحَمِيلِ، فَأَنْكَرَ ذَلِكَ، وَقَالَ: "قَدْ تَوَارَثَ الْمُهَاجِرُونَ، وَالْأَنْصَارُ بِنَسَبِهِمْ الَّذِي كَانَ فِي الْجَاهِلِيَّةِ".
Abdullah bin Awn narrated: Mention was made to Muhammad of those who claimed that the Hamīl has no heirs, so he refuted this and said: The Muhajirun and Ansar inherited from each other according to the lineage of the pre-Islamic period.
Hadith 3132
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، عَنْ ابْنِ إِدْرِيسَ، عَنْ هِشَامٍ، عَنْ الْحَسَنِ، وَابْنِ سِيرِينَ، قَالَا: "لَا يُوَرَّثُ الْحَمِيلُ إِلَّا بِبَيِّنَةٍ".
It is narrated from Hisham that Hasan and Ibn Sirin, may Allah have mercy on them, said: The heir of a "Hameel" without evidence will not be accepted.
Hadith 3133
حَدَّثَنَا أَبُو بَكْرٍ، حَدَّثَنَا جَرِيرٌ، عَنْ لَيْثٍ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ، قَالَ: "لَمْ يَكُنْ أَبُو بَكْرٍ، وَعُمَرُ، وَعُثْمَانُ يُوَرِّثُونَ الْحَمِيلَ".
Ibrahim, may Allah have mercy on him, said: Sayyiduna Abu Bakr, Sayyiduna Umar, and Sayyiduna Uthman, may Allah be pleased with them, did not consider the child born from adultery (hameel) as an heir.
Hadith 3134
حَدَّثَنَا أَبُو بَكْرٍ، حَدَّثَنَا عَبْدُ الرَّحِيمِ الْمُحَارِبِيُّ، عَنْ زَائِدَةَ، عَنْ أَشْعَثَ بْنِ أَبِي الشَّعْثَاءِ، قَالَ: "أَقَرَّتْ امْرَأَةٌ مِنْ مُحَارِبٍ جَلِيبَةٌ بِنَسَبٍ لَهَا جَلِيبٍ، فَوَرَّثَهُ عَبْدُ اللَّهِ بْنُ عُتْبَةَ مِنْ أُخْتِهِ".
Ash'ath bin Abi al-Sha'tha said: A woman from Banu Muharib acknowledged the lineage of her brother Julaib, so Abdullah bin Uqbah made her brother her heir.
Hadith 3135
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ، حَدَّثَنِي اللَّيْثُ، حَدَّثَنِي يُونُسُ، عَنْ ابْنِ شِهَابٍ، عَنْ رَجُلٍ قَالَ عِنْدَ فِرَاقِ الدُّنْيَا: أَنَا مَوْلَى فُلَانٍ، قَالَ: "يُرَدُّ مِيرَاثَهُ لِمَنْ سَمَّى أَنَّهُ مَوْلَاهُ عِنْدَ فِرَاقِ الدُّنْيَا، إِلَّا أَنْ يَأْتُوا عَلَيْهِ بِبَيِّنَةٍ بِغَيْرِ ذَلِكَ يَرُدُّونَ بِهِ قَوْلَهُ، فَيُرَدُّ مِيرَاثُهُ إِلَى مَا قَامَتْ بِهِ الْبَيِّنَةُ".
It is narrated from Ibn Shihab: If a person, at the time of departing from this world, says that he is the freed slave of such-and-such person, he said: His wealth should be returned to those owners whom he identified at the time of his departure from this world, unless the heirs bring forth some stronger evidence besides this. Therefore, in the light of proof and testimony, his inheritance will be given to the rightful owner.
