Hadith 3123
أَخْبَرَنَا يَحْيَى بْنُ حَسَّانَ، حَدَّثَنَا ابْنُ أَبِي الزِّنَادِ، عَنْ أَبِيهِ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي امْرَأَةِ الْأَسِيرِ: "أَنَّهَا تَرِثُهُ وَيَرِثُهَا".
Ibn Abi al-Zinad narrated from his father that Umar bin Abdul Aziz, may Allah have mercy on him, said regarding the wife of a prisoner that she will inherit from him and the prisoner will inherit from the woman.
Hadith 3124
حَدَّثَنَا مُحَمَّدُ بْنُ الْفَضْلِ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، حَدَّثَنِي مَعْمَرٌ، عَنْ إِسْحَاق بْنِ رَاشِدٍ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي الْأَسِيرِ يُوصِي، قَالَ: "أُجيزُ لَهُ وَصِيَّتَهُ مَا دَامَ عَلَى دِينِهِ لَمْ يَتَغَيَّرْ عَنْ دِينِهِ".
It is narrated from Ishaq bin Rashid. Umar bin Abdul Aziz, may Allah have mercy on him, said regarding a captive who makes a will: He said, I consider his will permissible as long as he remains on his religion, until he changes his religion.
Hadith 3125
أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ دَاوُدَ، عَنْ الشَّعْبِيِّ، عَنْ شُرَيْحٍ، قَالَ: "يُوَرَّثُ الْأَسِيرُ إِذَا كَانَ فِي أَيْدِي الْعَدُوِّ".
Qadi Shurayh, may Allah have mercy on him, said: When a prisoner is in the custody of the enemy, he will be considered an heir.
Hadith 3126
حَدَّثَنَا مُحَمَّدٌ، قَالَ: حَدَّثَنَا سُفْيَانُ، حَدَّثَنِي مَنْ سَمِعَ إِبْرَاهِيمَ، يَقُولُ: "يُوَرَّثُ الْأَسِيرُ".
Sufyan said: Whoever heard from Ibrahim (may Allah have mercy on him), he narrated that Ibrahim (may Allah have mercy on him) used to say: The captive will be considered an heir.
Hadith 3127
حَدَّثَنَا الْمُعَلَّى بْنُ أَسَدٍ، حَدَّثَنَا وُهَيْبٌ، عَنْ دَاوُدَ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ: أَنَّهُ كَانَ "لَا يُوَرِّثُ الْأَسِيرَ".
Dawud (ibn Abi Hind) said: Sa'id ibn al-Musayyib, may Allah have mercy on him, did not consider a captive to be an heir.
