باب فَرَائِضِ الْمَجُوسِ:
Chapter on the inheritance laws of the Magians
Hadith 3120
أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، حَدَّثَنَا عَبْدُ الْأَعْلَى، عَنْ مَعْمَرٍ، عَنْ الزُّهْرِيِّ، قَالَ: "إِذَا اجْتَمَعَ نَسَبَانِ، وُرِّثَ بِأَكْبَرِهِمَا، يَعْنِي الْمَجُوسَ".
Imam Zuhri, may Allah have mercy on him, said: When two lineages of the Magians are combined, the one who is greater will be the heir.
Hadith 3121
حَدَّثَنَا حَجَّاجُ بْنُ مِنْهَالٍ، حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ حَمَّادِ بْنِ أَبِي سُلَيْمَانَ، قَالَ: "يَرِثُ مِنْ الْجَانِبِ الَّذِي يَصْلُحُ، وَلَا يَرِثُ مِنْ الْجَانِبِ الَّذِي لَا يَصْلُحُ".
Hammad bin Abi Sulayman said: In the case of two lineages, the one from which the lineage is valid will inherit, and the one from which the lineage is not valid will not inherit.
Hadith 3122
حَدَّثَنَا حَجَّاجٌ، حَدَّثَنَا حَمَّادٌ، عَنْ سُفْيَانَ الثَّوْرِيِّ، عَنْ رَجُلٍ، عَنْ الشَّعْبِيِّ: أَنَّ عَلِيًّا، وَابْنَ مَسْعُودٍ، قَالَا فِي الْمَجُوسِ: "إِذَا أَسْلَمُوا، يَرِثُونَ مِنْ الْقَرَابَتَيْنِ جَمِيعًا".
Imam Sha’bi (may Allah have mercy on him) said: Sayyiduna Ali and Sayyiduna Ibn Mas’ud (may Allah be pleased with them both) said regarding the Magians that when they become Muslim, they will inherit from both sides of kinship.
