Hadith 3082
It is narrated from Bakr bin Abdullah Muzani that a man died and left behind his paternal aunt and maternal aunt. Sayyiduna Umar (may Allah be pleased with him) gave the paternal aunt the share of a brother and the maternal aunt the share of a sister.
Hadith 3083
أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، عَنْ الْأَعْمَشِ، عَنْ إِبْرَاهِيمَ، قَالَ: "مَنْ أَدْلَى بِرَحِمٍ، أُعْطِيَ بِرَحِمِهِ الَّتِي يُدْلِي بِهَا".
Ibrahim (may Allah have mercy on him) said: Whoever claims kinship (closeness by the womb), he will be given a share according to the closeness of kinship (relationship by the womb).
Hadith 3084
حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، قَالَ: حَدَّثَنِي أَبُو إِسْحَاق الشَّيْبَانِيُّ، عَنْ الشَّعْبِيِّ: "فِي رَجُلٍ تَرَكَ عَمَّتَهُ، وَابْنَةَ أَخِيهِ، قَالَ: الْمَالُ لِابْنَةِ أَخِيهِ".
It is narrated from Sha'bi, may Allah have mercy on him, regarding the man who left behind his paternal aunt and his niece; he said: The niece will inherit the wealth.
Hadith 3085
It is narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that the Noble Prophet, peace and blessings be upon him, said: "Whoever has no heir, his maternal uncle is his heir."
Hadith 3086
Ibrahim, may Allah have mercy on him, said: The opinion of Sayyiduna Umar and Sayyiduna Abdullah bin Mas'ud, may Allah be pleased with them both, was that the maternal uncle would be the heir.
Hadith 3087
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا حَسَنٌ، عَنْ سُلَيْمَانَ أَبِي إِسْحَاق، عَنْ الشَّعْبِيِّ: فِي عَمَّةٍ، وَبِنْتِ أَخٍ، قَالَ: "الْمَالُ لِابْنَةِ الْأَخِ".
It is narrated from Sha'bi, may Allah have mercy on him, regarding the paternal aunt and the niece that all the wealth will go to the niece.
Hadith 3088
حَدَّثَنَا أَبُو نُعَيْمٍ، أنبأنا حَسَنٌ، عَنْ سُلَيْمَانَ، عَنْ بَعْضِهِمْ، عَنْ إِبْرَاهِيمَ، قَالَ: "لِلْعَمَّةِ".
Ibrahim, may Allah have mercy on him, said: The wealth will be for the paternal aunt.
Hadith 3089
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا سُفْيَانُ، عَنْ الشَّيْبَانِيِّ، عَنْ الشَّعْبِيِّ: فِي بِنْتِ أَخٍ، وَعَمَّةٍ، قَالَ: "أَعْطِي الْمَالَ لِابْنَةِ الْأَخِ".
It is narrated from Sha'bi (may Allah have mercy on him) regarding the paternal aunt and the niece that all the wealth will go to the brother's daughter.
Hadith 3090
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا سُفْيَانُ، عَنْ الشَّيْبَانِيِّ، عَنْ الشَّعْبِيِّ: فِي بِنْتِ أَخٍ، وَعَمَّةٍ، قَالَ: "أَعْطِي الْمَالَ لِابْنَةِ الْأَخِ".
It is narrated from Sha'bi, may Allah have mercy on him, regarding the niece and the paternal aunt, that I will give the wealth to the niece.
Hadith 3091
حَدَّثَنَا
يَعْلَى، حَدَّثَنَا
زَكَرِيَّا، عَنْ
عَامِرٍ، عَنْ
مَسْرُوقٍ: فِي رَجُلٍ تُوُفِّيَ وَلَيْسَ لَهُ وَارِثٌ إِلَّا ابْنَةُ أَخِيهِ وَخَالُهُ، قَالَ:
"لِلْخَالِ نَصِيبُ أُخْتِهِ، وَلِابْنَةِ الْأَخِ نَصِيبُ أَبِيهَا".
It is narrated from Masruq (may Allah have mercy on him): A man died and had no heirs except a niece and a maternal uncle. He said: The maternal uncle receives a share equal to that of the deceased's sister, and the niece receives the share of her father (i.e., the share of the deceased's brother).
Hadith 3092
حَدَّثَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
يُونُسُ، عَنْ
عَامِرٍ، قَالَ: "كَانَ
مَسْرُوقٌ يُنَزِّلُ الْعَمَّةَ بِمَنْزِلَةِ الْأَبِ، إِذَا لَمْ يَكُنْ أَبٌ، وَالْخَالَةَ بِمَنْزِلَةِ الْأُمِّ، إِذَا لَمْ تَكُنْ أُمٌّ".
It is narrated from ‘Amir (Sha‘bi) رحمه الله that Masruq رحمه الله used to consider the paternal aunt, in the absence of the father, in the position of the father, and the maternal aunt, when there was no maternal uncle, in the position of the mother. That is, in the absence of the parents, he would give the paternal aunt and maternal aunt the share of inheritance of the father and mother.
Hadith 3093
حَدَّثَنَا
يَعْلَى، عَنْ
مُحَمَّدِ بْنِ إِسْحَاق، عَنْ
مُحَمَّدِ بْنِ حَبَّانَ نَسَبَهُ إِلَى جَدِّهِ، عَنْ عَمِّهْ
وَاسِعِ بْنِ حَبَّانَ، قَالَ: تُوُفِّيَ ابْنُ الدَّحْدَاحَةِ، وَكَانَ أَتِيًّا، وَهُوَ الَّذِي لَا يُعْرَفُ لَهُ أَصْلٌ، فَكَانَ فِي بَنِي الْعَجْلَانِ، وَلَمْ يَتْرُكْ عَقِبًا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِعَاصِمِ بْنِ عَدِيٍّ:
"هَلْ تَعْلَمُونَ لَهُ فِيكُمْ نَسَبًا ؟ قَالَ: مَا نَعْرِفُهُ يَا رَسُولَ اللَّهِ، فَدَعَا ابْنَ أُخْتِهِ، فَأَعْطَاهُ مِيرَاثَهُ.
It is narrated from Wasi‘ bin Hibban that Ibn al-Dahdahah passed away and he used to come, meaning there was no information about his relatives or kin. He was from Banu ‘Ajlan and had left behind no heirs. The Messenger of Allah (peace and blessings be upon him) said to Sayyiduna ‘Asim bin ‘Adi (may Allah be pleased with him): “Do you have knowledge of his lineage among your tribe?” He replied: O Messenger of Allah! We do not know him. So the Messenger of Allah (peace and blessings be upon him) called his nephew and gave him his entire inheritance.
Hadith 3094
Ibrahim (may Allah have mercy on him) narrated that Sayyiduna Umar (may Allah be pleased with him) gave inheritance wealth to the maternal uncle.
Hadith 3095
حَدَّثَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
أَبُو هَانِئٍ، قَالَ: سُئِلَ
عَامِرٌ عَنْ امْرَأَةٍ أَوْ رَجُلٍ، تُوُفِّيَ وَتَرَكَ خَالَةً وَعَمَّةً، قَالَ: "لَيْسَ لَهُ وَارِثٌ وَلَا رَحِمٌ غَيْرُهُمَا"، فَقَالَ: كَانَ
عَبْدُ اللَّهِ بْنُ مَسْعُودٍ يُنَزِّلُ الْخَالَةَ بِمَنْزِلَةِ أُمِّهِ، وَيُنَزِّلُ الْعَمَّةَ بِمَنْزِلَةِ أَخِيهَا.
Abu Hani said: 'Amir Sha'bi, may Allah have mercy on him, was asked: If a woman or a man passes away, and leaves behind a maternal aunt and a paternal aunt, and besides them there is no other heir or relative, Sha'bi, may Allah have mercy on him, said: Sayyiduna Abdullah ibn Mas'ud, may Allah be pleased with him, used to give the maternal aunt the share of the mother and the paternal aunt the share of her brother, that is, the deceased woman's brother.
