باب مَنْ قَالَ لاَ يُوَرَّثُ:
Chapter on those who say she does not inherit
Hadith 3075
حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ، حَدَّثَنَا إِسْمَاعِيل، عَنْ عَامِرٍ، قَالَ: "كَانَ عَلِيٌّ لَا يُوَرِّثُ الْإِخْوَةَ مِنْ الْأُمِّ، وَلَا الزَّوْجَ، وَلَا الْمَرْأَةَ، مِنْ الدِّيَةِ شَيْئًا" . قَالَ عَبْد اللَّهِ: بَعْضُهُمْ يُدْخِلُ بَيْنَ إِسْمَاعِيل، وَعَامِرٍ رَجُلًا.
‘Amir (Sha‘bi), may Allah have mercy on him, said: Sayyiduna ‘Ali, may Allah be pleased with him, did not give anything from the blood money as inheritance to the maternal brother, the husband, or the wife. Imam Darimi, may Allah have mercy on him, said: In some narrations, there is one more narrator mentioned between ‘Amir Sha‘bi and Isma‘il.
Hadith 3076
حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ زِيَادٍ الْأَعْلَمِ، عَنْ الْحَسَنِ، قَالَ: "لَا تُوَرَّثُ الْإِخْوَةُ مِنْ الْأُمِّ مِنْ الدِّيَةِ".
Hasan (may Allah have mercy on him) said: Akhiyafi brothers will not be heirs to blood money.
