Hadith 3055
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Umar, Sayyiduna Ali, Sayyiduna Zaid, and I think Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with them all) all said: The right of inheritance (wala') is for the closest, and by "closest" they meant the one who is nearest to the father and mother.
Hadith 3056
حَدَّثَنَا حَدَّثَنَا
يَزِيدُ، حَدَّثَنَا
أَشْعَثُ، عَنْ
ابْنِ سِيرِينَ، عَنْ
عَبْدِ اللَّهِ بْنِ عُتْبَةَ، قَالَ: "كَتَبَ إِلَيَّ عُمَرُ فِي شَأْنِ فُكَيْهَةَ بِنْتِ سَمْعَانَ أَنَّهَا مَاتَتْ وَتَرَكَتْ ابْنَ أَخِيهَا لِأَبِيهَا وَأُمِّهَا، وَابْنَ أَخِيهَا لِأَبِيهَا، فَكَتَبَ
عُمَرُ:
إِنَّ الْوَلَاءَ لِلْكُبْرِ".
Ubaydullah bin Utbah said: Sayyiduna Umar (may Allah be pleased with him) wrote to me regarding Fakiha bint Sam'an, who had passed away and had left behind a son of her real brother and a son of her paternal brother. Sayyiduna Umar (may Allah be pleased with him) wrote that the right of inheritance belongs to the elder (i.e., the son of the real brother).
Hadith 3057
It is narrated from Sha'bi (may Allah have mercy on him) that Sayyiduna Ali and Sayyiduna Zaid (may Allah be pleased with them both) said: The right of wala' is for the eldest, and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) and (Qadi) Shurayh said: It will be for the heirs.
Hadith 3058
Shu’bi (may Allah have mercy on him) said: Sayyiduna ‘Umar, Sayyiduna ‘Abdullah, Sayyiduna ‘Ali, and Sayyiduna Zayd (may Allah be pleased with them) gave the ruling of wala’ (patronage) to the greater (heir).
Hadith 3059
حَدَّثَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
شَرِيكٌ، عَنْ
أَشْعَثَ، عَنْ
ابْنِ سِيرِينَ، قَالَ: "تُوُفِّيَتْ فُكَيْهَةُ بِنْتُ سَمْعَانَ وَتَرَكَتْ ابْنَ أَخِيهَا لِأَبِيهَا، وَبَنِي بَنِي أَخِيهَا لِأَبِيهَا وَأُمِّهَا،
فَوَرَّثَ عُمَرُ بَنِي أَخِيهَا لِأَبِيهَا".
Ibn Sirin, may Allah have mercy on him, said: Fakiha bint Sam'an passed away and left behind a paternal uncle's son and a real brother's grandson, so Sayyiduna Umar, may Allah be pleased with him, made the paternal uncle's sons heirs (because the grandson is a more distant relative).
Hadith 3060
It is narrated from Ibrahim al-Nakha'i (may Allah have mercy on him): Sayyiduna Umar, Sayyiduna Ali, and Sayyiduna Zayd (may Allah be pleased with them all) all said: The right of inheritance (wala’) is for the eldest.
Hadith 3061
It is narrated from Mughira that Ibrahim (may Allah have mercy on him) said regarding two brothers who inherited a slave whom their father had set free. One of the two brothers died and left behind his son. Ibrahim (may Allah have mercy on him) said: Sayyiduna Ali, Sayyiduna Zaid, and Sayyiduna Abdullah (may Allah be pleased with them) used to say: The right of wala’ is for the elder, that is, for the brother; there is nothing for the children of the brother.
Hadith 3062
Mutar Al-Warraq said: Sayyiduna Umar and Sayyiduna Ali (may Allah be pleased with them both) said: The right of allegiance (wala’) is for the elder.
Hadith 3063
أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى، عَنْ رَوْحٍ، عَنْ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، وَابْنِ جُرَيْجٍ، عَنْ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ، قَالَ: "الْوَلَاءُ لِلْكُبْرِ".
Tawoos (may Allah have mercy on him) said: The right of allegiance is for the elder.
Hadith 3064
أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ إِسْرَائِيلَ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، قَالَ: "الْوَلَاءُ لِلْكُبْرِ".
Ibrahim, may Allah have mercy on him, said: The right of inheritance through wala’ belongs to the eldest.
