Hadith 3035
حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، قَالَ: "لَيْسَ لِلْمُكَاتَبِ مِيرَاثٌ، مَا بَقِيَ عَلَيْهِ شَيْءٌ مِنْ مُكَاتَبَتِهِ".
Ibrahim, may Allah have mercy on him, said: There is no inheritance for the mukatab as long as there remains an amount due upon him according to the contract.
Hadith 3036
حَدَّثَنَا
يَعْلَى، حَدَّثَنَا
عَبْدُ الْمَلِكِ، عَنْ
عَطَاءٍ: "فِي رَجُلٍ لَهُ بَنُونَ قَدْ أَعْتَقَ مِنْ بَعْضِهِمْ النِّصْفَ، وَمِنْ بَعْضٍ الثُّلُثَ، وَمِنْ بَعْضٍ الرُّبُعَ، قَالَ:
لَا يَرِثُونَ حَتَّى يُعْتَقُوا".
It is narrated from Ata that regarding a man whose sons are slaves, some of whom have been freed by one-third and some by one-fourth. Ata said: Until they are completely freed, they will not be heirs (of the father).
Hadith 3037
حَدَّثَنَا عبد الله بن جعفر الرقي، وَسَعِيدُ بْنُ الْمُغِيرَةِ، عَنْ ابْنِ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ حَمَّادٍ، عَنْ إِبْرَاهِيمَ: "فِي رَجُلٍ اشْتَرَى ابْنَهُ فِي مَرَضِهِ، قَالَ: إِنْ خَرَجَ مِنْ الثُّلُثِ وَرِثَهُ، وَإِنْ وَقَعَتْ عَلَيْهِ السِّعَايَةُ لَمْ يَرِثْ".
It is narrated from Ibrahim, may Allah have mercy on him, regarding the man who, in his illness (of death), bought his son, and if it exceeds one third, then (the son) will be an heir of the father; and if the wealth to be given is yet to be determined, then he will not be an heir.
Hadith 3038
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا حَسَنٌ، عَنْ أَبِيهِ، عَنْ الشَّعْبِيِّ، قَالَ: "حَدُّ الْمُكَاتَبِ حَدُّ الْمَمْلُوكِ، حَتَّى يُعْتَقَ".
Shu'bi, may Allah have mercy on him, said: The legal punishment (hadd) for a mukatab is the same as that for a slave until he is set free.
