Hadith 3021
It is narrated from Muhammad bin Ash’ath that his Jewish paternal aunt died in Yemen. He mentioned this to Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him), so he said: Whoever among her close relatives is upon her religion will be her heir. (That is, since you are a Muslim, you will not inherit from this Jewish aunt; only her Jewish relative will be her heir.)
Hadith 3022
Tariq bin Shihab said: The paternal aunt of Ash'ath bin Qais passed away, and she was a Jew. He came to Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him), so he replied: Only those who are upon her religion (i.e., only the Jews) will inherit from her.
Hadith 3023
Ibrahim, may Allah have mercy on him, said: Sayyiduna Umar ibn al-Khattab, may Allah be pleased with him, said: We do not inherit from the polytheists, nor do they inherit from us.
Hadith 3024
Shu’bi (may Allah have mercy on him) said: Indeed, the Messenger of Allah (peace and blessings be upon him), and Sayyiduna Abu Bakr and Sayyiduna Umar (may Allah be pleased with them both), did not consider people of two (different) religions to inherit from one another.
Hadith 3025
Aamir (Ash-Sha'bi) رحمه الله said: Sayyiduna Umar رضي الله عنه said: People of two (different) religions will not inherit from each other.
Hadith 3026
Sayyiduna Jabir (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) said: "We will neither inherit from the People of the Book, nor will they inherit from us. Except if a man's slave or his slave-girl dies." (That is, a Muslim cannot inherit from a non-Muslim, but if someone's non-Muslim slave or slave-girl dies, then their property will go to the master.)

Hadith 3028
Masruq (may Allah have mercy on him) said: Sayyiduna Muawiyah (may Allah be pleased with him) considered a Muslim to be the heir of a disbeliever, but did not consider a disbeliever to be the heir of a Muslim. Shu’bi (may Allah have mercy on him) said: Masruq said: In Islam, I have not found any decision better than this. Imam Darimi (may Allah have mercy on him) was asked: Do you also say the same? He said: No (i.e., inheritance between the two is not permissible, as will be mentioned ahead in the authentic hadith).
Hadith 3029
حَدَّثَنَا
يَزِيدُ بْنُ هَارُونَ، عَنْ
دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنْ
عَامِرٍ: أَنَّ الْمُعْزِلَةَ بِنْتَ الْحَارِثِ تُوُفِّيَتْ بِالْيَمَنِ وَهِيَ يَهُودِيَّةٌ، فَرَكِبَ الْأَشْعَثُ بْنُ قَيْسٍ، وَكَانَتْ عَمَّتَهُ، إِلَى عُمَرَ فِي مِيرَاثِهَا، فَقَالَ
عُمَرُ: "لَيْسَ ذَاكَ لَكَ،
يَرِثُهَا أَقْرَبُ النَّاسِ مِنْهَا مِنْ أَهْلِ دِينِهَا، لَا يَتَوَارَثُ مِلَّتَانِ".
‘Amir al-Sha‘bi (may Allah have mercy on him) said: Mu‘azilah bint Harith, a Jewish woman, died in Yemen. Al-Ash‘ath ibn Qays, whose paternal aunt she was, rode to ask about her inheritance from Sayyiduna ‘Umar (may Allah be pleased with him). Sayyiduna ‘Umar (may Allah be pleased with him) said: “You cannot inherit from her. Only her close relative from her own religion will inherit from her, because people of two different religions do not inherit from one another.”
Hadith 3030
Anas bin Sirin said: Sayyiduna Umar (may Allah be pleased with him) said: People of two different religions will not inherit from each other, and the one who does not inherit will also not cause deprivation.
Hadith 3031
It is narrated from Sayyiduna Usama bin Zaid (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "A Muslim cannot be the heir of a disbeliever, nor can a disbeliever be the heir of a Muslim."
Hadith 3032
حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ، عَنْ سَعِيدٍ، عَنْ أَبِي مَعْشَرٍ، عَنْ إِبْرَاهِيمَ، قَالَ: "إِذَا مَاتَ الْمَيِّتُ وَجَبَتْ الْحُقُوقُ لِأَهْلِهَا، وَلَمْ يَجْعَلْ لِمَنْ أَسْلَمَ أَوْ أُعْتِقَ قَبْلَ أَنْ يُقْسَمَ الْمِيرَاثُ شَيْئًا".
Ibrahim, may Allah have mercy on him, said: When a man dies, the right of inheritance becomes obligatory for the heir, and whoever becomes Muslim or is freed before the distribution of inheritance, nothing from the inheritance is kept for him.
Hadith 3033
Sayyiduna Usama bin Zaid (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) said: "A Muslim cannot inherit from a disbeliever, nor can a disbeliever inherit from a Muslim."
