Hadith 3015
Dahhak bin Qais narrated that Sayyiduna Umar (may Allah be pleased with him) made a decision regarding inheritance during the plague of Amwas (or the first plague that occurred in the era of Islam): that the heirs who are children from the father's side will all be equal in rank, but those from the mother's side will have more right, and among the heirs, whoever is closer to the father will have more right to the wealth.
Hadith 3016
Abdullah bin Shaddad bin Al-Had said: The freed slave of Abu Hudhaifah, Salim, was killed in the Battle of Yamamah and he left two hundred dirhams as inheritance. Sayyiduna Umar (may Allah be pleased with him) said: Keep (these dirhams) reserved for his mother until she passes away.
Hadith 3017
حَدَّثَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
زُهَيْرٌ، عَنْ
أَبِي إِسْحَاق، عَنْ
الْحَارِثِ، عَنْ
عَلِيٍّ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ:
"الْإِخْوَةُ مِنْ الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ، يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ، دُونَ أَخِيهِ لِأَبِيهِ".
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: "Maternal brothers will inherit, paternal brothers will not inherit, and a man will inherit from his full brother except for the paternal brother (that is, the paternal brother will not inherit in the presence of the full brother)."
Hadith 3018
Nu’man bin Salim said: I asked Sayyiduna Ibn Umar (may Allah be pleased with them both): What is your opinion regarding a man who dies leaving behind his grandson, will he inherit from the deceased? Sayyiduna Ibn Umar (may Allah be pleased with them both) said: No (because the grandson is not an heir, so even as an ‘asaba he will not receive the inheritance).
Hadith 3019
Ibrahim, may Allah have mercy on him, said: Sayyiduna Abdullah bin Mas'ud, may Allah be pleased with him, said: The mother is the 'asaba (agnate) of the one who has no other 'asaba, and the sister is the 'asaba of the one who has no other 'asaba.
Hadith 3020
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: "Give the inheritance to those who are entitled to it, and whatever remains, it is for the closest male relative (of the deceased)."
