باب قَوْلِ عَلِيٍّ وَزَيْدٍ في الْجَدَّاتِ:
Chapter on the opinions of Ali and Zayd regarding grandmothers
Hadith 2973
أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا الْأَشْعَثُ، عَنْ الشَّعْبِيِّ، عَنْ عَلِيٍّ، وَزَيْدٍ قَالَا: "إِذَا كَانَتْ الْجَدَّاتُ سَوَاءً، وَرِثَ ثَلَاثُ جَدَّاتٍ جَدَّتَا أَبِيهِ أُمُّ أُمِّهِ، وَأُمُّ أَبِيهِ، وَجَدَّةُ أُمِّهِ، فَإِنْ كَانَتْ إِحَدَاهُنَّ أَقْرَب، فَالسَّهْمُ لِذَوِي الْقُرْبَى.
It is narrated from Imam Sha’bi (may Allah have mercy on him) that Sayyiduna Ali and Sayyiduna Zaid (may Allah be pleased with them both) said: When the grandmothers are of the same degree, then three grandmothers will inherit: two are the paternal grandmothers, that is, the father’s mother and the father’s mother’s mother, and the third is the maternal grandmother’s mother. Whichever of them is closer, it will be for «سهم ذوي القربي».
Hadith 2974
أَخْبَرَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا حَسَنٌ، عَنْ أَشْعَثَ، عَنْ الشَّعْبِيِّ، عَنْ عَلِيٍّ، وَزَيْدٍ: "أَنَّهُمَا كَانَا لا يُوَرِّثَانِ الْجِدَّةَ أُمَّ الأَبِ مَعَ الأَبِ". [إسناده ضعيف لضعف أشعث بن سوار] ¤ حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ، عَنْ ابْنِ الْمُبَارَكِ، عَنْ مَعْمَرٍ، عَنْ الزُّهْرِيِّ، أَنَّ عُثْمَانَ «كَانَ لَا يُوَرِّثُ الْجَدَّةَ وَابْنُهَا حَيٌّ» [إسناده صحيح إلى الزهري]
It is narrated from (Ibn Shihab) Zuhri, may Allah have mercy on him, that Sayyiduna Uthman, may Allah be pleased with him, would not give the grandmother a share of inheritance in the presence of her son.
