باب قَوْلِ أَبِي بَكْرٍ الصِّدِّيقِ في الْجَدَّاتِ:
Chapter on Abu Bakr's opinion regarding grandmothers
Hadith 2972
أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا الْأَشْعَثُ، عَنْ الزُّهْرِيِّ، قَالَ: جَاءَتْ إِلَى أَبِي بَكْرٍ جَدَّةٌ أُمُّ أَبٍ، أَوْ أُمُّ أُمٍّ، فَقَالَتْ: إِنَّ ابْنَ ابْنِي أَوْ ابْنَ ابْنَتِي تُوُفِّيَ، وَبَلَغَنِي أَنَّ لِي نَصِيبًا، فَمَا لِي ؟ فَقَالَ أَبُو بَكْرٍ: مَا سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فِيهَا شَيْئًا، وَسَأَسْأَلُ النَّاسَ، فَلَمَّا صَلَّى الظُّهْر، قَالَ: أَيُّكُمْ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ فِي الْجَدَّةِ شَيْئًا ؟ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ: أَنَا، قَالَ: مَاذَا ؟ قَالَ: أَعْطَاهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُدُسًا، قَالَ: أَيَعْلَمُ ذَاكَ أَحَدٌ غَيْرُكَ ؟ فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ: صَدَقَ، فَأَعْطَاهَا أَبُو بَكْرٍ السُّدُسَ، فَجَاءَتْ إِلَى عُمَرَ مِثْلُهَا، فَقَال: مَا أَدْرِي، مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيهَا شَيْئًا، وَسَأَسْأَلُ النَّاسَ، فَحَدَّثُوهُ بِحَدِيثِ الْمُغِيرَةِ بْنِ شُعْبَةَ، وَمُحَمَّدِ بْنِ مَسْلَمَةَ، فَقَالَ عُمَرُ: أَيُّكُمَا خَلَتْ بِهِ فَلَهَا السُّدُسُ، فَإِنْ اجْتَمَعْتُمَا، فَهُوَ بَيْنَكُمَا.
Imam Zuhri Ibn Shihab, may Allah have mercy on him, said: A grandmother (either paternal or maternal) came to Sayyiduna Abu Bakr, may Allah be pleased with him, and said: My grandson (son’s son or daughter’s son) has died and I have heard that I have a share in the inheritance, so what is there for me? Sayyiduna Abu Bakr as-Siddiq, may Allah be pleased with him, said: I have not heard anything about this from the Messenger of Allah, peace and blessings be upon him, but I will ask the people. So when he had performed the Zuhr prayer, he said: Has any of you heard anything from the Messenger of Allah, peace and blessings be upon him, regarding the grandmother? Sayyiduna Mughirah bin Shu’bah, may Allah be pleased with him, said: Yes, I have heard. Sayyiduna Abu Bakr, may Allah be pleased with him, said: What have you heard? He said: The Messenger of Allah, peace and blessings be upon him, granted her one-sixth (of the inheritance). Sayyiduna Abu Bakr as-Siddiq, may Allah be pleased with him, said: Does anyone else besides you know of this? Sayyiduna Muhammad bin Maslamah, may Allah be pleased with him, testified that Sayyiduna Mughirah, may Allah be pleased with him, had spoken the truth. So Sayyiduna Abu Bakr as-Siddiq, may Allah be pleased with him, gave the woman one-sixth. Then a woman came to Sayyiduna Umar, may Allah be pleased with him, with a similar issue, so he said: I do not remember having heard anything about this from the Messenger of Allah, peace and blessings be upon him, but I will ask the people. The people narrated to him the hadith of Sayyiduna Mughirah bin Shu’bah and Sayyiduna Muhammad bin Maslamah, may Allah be pleased with them both, so Sayyiduna Umar, may Allah be pleased with him, said: Whichever one of you (grandmothers) is present, she will have one-sixth, and if both are present, then this same one-sixth will be divided between them.
