باب قَوْلِ زَيْدٍ في الْجَدِّ:
Chapter on Zayd's opinion regarding the grandfather
Hadith 2961
أَخْبَرَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا وُهَيْبٌ، حَدَّثَنَا يُونُسُ، عَنْ الْحَسَنِ: أَنَّ زَيْدًا كَانَ "يُشَرِّكُ الْجَدَّ مَعَ الْإِخْوَةِ إِلَى الثُّلُثِ".
Hasan (may Allah have mercy on him) said that Sayyiduna Zaid (may Allah be pleased with him) used to make the grandfather a partner with the brothers in one third.
Hadith 2962
حَدَّثَنَا عُمَرُ بْنُ حَفْصِ بْنِ غِيَاثٍ، حَدَّثَنَا أَبِي، حَدَّثَنَا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنْ زَيْدِ بْنِ ثَابِتٍ: أَنَّهُ كَانَ "يُقَاسِمُ بِالْجَدِّ مَعَ الْإِخْوَةِ إِلَى الثُّلُثِ، ثُمَّ لَا يُنْقِصُهُ".
Ibrahim, may Allah have mercy on him, said: Sayyiduna Zayd bin Thabit, may Allah be pleased with him, used to allocate one-third to the grandfather along with the brothers, and he would not reduce it.
Hadith 2963
حَدَّثَنَا حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ، عَنْ عِيسَى بْنِ يُونُسَ، عَنْ إِسْمَاعِيل، قَالَ: قَالَ عَامِرٌ: "خُذْ مِنْ أَمْرِ الْجَدِّ مَا اجْتَمَعَ النَّاسُ عَلَيْهِ، قَالَ أَبُو مُحَمَّدٍ: يَعْنِي قَوْلَ زَيْدٍ.
It is narrated from Ismail that 'Amir (al-Sha'bi) said: Act upon that regarding the grandfather on which the (scholars) of the people have consensus. Imam Darimi, may Allah have mercy on him, said: That is, adopt the statement of Sayyiduna Zaid, may Allah be pleased with him.
