Hadith 2947
أَخْبَرَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ عَاصِمٍ، عَنْ الشَّعْبِيِّ، قَالَ: "إِنَّ أَوَّلَ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَرُ.
Shu’bi (may Allah have mercy on him) said: In Islam, the first person to inherit as a grandfather was Sayyiduna ‘Umar (may Allah be pleased with him).
Hadith 2948
حَدَّثَنَا حَدَّثَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
حَسَنٌ، عَنْ
عَاصِمٍ، عَنْ
الشَّعْبِيِّ، قَالَ:
"أَوَّلُ جَدٍّ وَرِثَ فِي الْإِسْلَامِ عُمَر، فَأَخَذَ مَالَهُ، فَأَتَاهُ عَلِيٌّ، وَزَيْدٌ، فَقَالَا: لَيْسَ لَكَ ذَاكَ، إِنَّمَا أَنْتَ كَأَحَدِ الْأَخَوَيْنِ".
Shu’bi (may Allah have mercy on him) said: The first grandfather to inherit in Islam was Sayyiduna ‘Umar (may Allah be pleased with him); he took his share, so Sayyiduna ‘Ali and Sayyiduna Zayd (may Allah be pleased with them both) came to him and said: Not like this, you are like two brothers.
Hadith 2949
Shu'bi, may Allah have mercy on him, said: Sayyiduna Umar, may Allah be pleased with him, used to include the grandfather in the division along with one or two brothers; if the brothers were more, he would give the grandfather one-third, and with children, he would give him one-sixth.
Hadith 2950
It is narrated from Marwan bin Al-Hakam that when Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him) was wounded by a spear, he consulted the companions regarding the grandfather, and said: "I had an opinion regarding the grandfather; if you wish, you may follow it." Sayyiduna Uthman (may Allah be pleased with him) said: "If we follow your opinion, it is a path of guidance, and if we accept the opinion of the Shaykh (Sayyiduna Abu Bakr, may Allah be pleased with him), he too was a man of very good opinion."
