Chapter on slaves and People of the Book
Hadith 2931
حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ، عَنْ عَلِيِّ بْنِ مُسْهِرٍ، عَنْ أَشْعَثَ، عَنْ الشَّعْبِيِّ: أَنَّ عَلِيًّا، وَزَيْدًا كَانَا "لَا يَحْجُبَانِ بِالْكُفَّار، وَلا بِالْمَمْلُوكِينَ، وَلَا يُوَرِّثَانِهِمْ شَيْئًا" . وَكَانَ عَبْدُ اللَّهِ "يَحْجُبُ بِالْكُفَّارِ وَبِالْمَمْلُوكِينَ، وَلَا يُوَرِّثُهُمْ" ..
Shu’bi said that Sayyiduna Ali and Sayyiduna Zaid (may Allah be pleased with them both) would not disinherit any heir because of disbelievers or slaves, nor would they make disbelievers or slaves heirs to anything. And Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) would disinherit because of disbelievers and slaves, but he would not give them inheritance.
Hadith 2932
حَدَّثَنَا حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، حَدَّثَنَا شُعْبَةُ، عَنْ الْحَكَمِ، عَنْ إِبْرَاهِيمَ: أَنَّ عَلِيًّا، وَزَيْدًا، قَالَا: "الْمَمْلُوكُونَ، وَأَهْلُ الْكِتَابِ لا يَحْجُبُونَ وَلا يَرِثُونَ . وَقَالَ عَبْدُ اللَّهِ: "يَحْجُبُونَ وَلَا يَرِثُونَ" ..
Ibrahim said: Sayyiduna Ali and Sayyiduna Zaid (may Allah be pleased with them both) said: Slaves and People of the Book will neither be deprived nor will they inherit, and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: They will indeed be deprived but will not inherit.
