Hadith 2925
أَخْبَرَنَا
أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا
أَبُو شِهَابٍ، عَنْ
الْأَعْمَشِ، عَنْ
مُسْلِمٍ، عَنْ
مَسْرُوقٍ، عَنْ
عَبْدِ اللَّهِ: أَنَّهُ كَانَ يَقُولُ فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ، وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ: قَالَ:
"لِلْأَخَوَاتِ لِلْأَبِ وَالْأُمِّ الثُّلُثَانِ، وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ"، فَقَدِمَ مَسْرُوقٌ الْمَدِينَةَ، فَسَمِعَ قَوْلَ
زَيْدٍ فِيهَا فَأَعْجَبَهُ، فَقَالَ لَهُ بَعْضُ أَصْحَابِهِ: أَتَتْرُكُ قَوْلَ عَبْدِ اللَّهِ ؟ قَالَ: إِنِّي أَتَيْتُ الْمَدِينَةَ فَوَجَدْتُ زَيْدَ بْنَ ثَابِتٍ مِنْ الرَّاسِخِينَ فِي الْعِلْمِ . قَالَ أَحْمَدُ: فَقُلْتُ لِأَبِي شِهَاب: وَكَيْفَ قَالَ زَيْدٌ فِيهَا ؟ قَالَ: شَرَّكَ بَيْنَهُمْ.
It is narrated from Masruq (may Allah have mercy on him) that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said regarding full sisters and paternal sisters: "For the full sisters there will be two-thirds, and what remains will be only for the men, not for the women." Then when Masruq came to Madinah, he heard the statement of Sayyiduna Zayd bin Thabit (may Allah be pleased with him), which he liked very much. Some of his students said: "Will you leave the statement of your teacher, Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him)?" He replied: "When I came to Madinah, I found Sayyiduna Zayd bin Thabit (may Allah be pleased with him) among those with strong and firm knowledge."
Ahmad bin Abdullah bin Yunus said: I asked Ibn Shihab: "What did Sayyiduna Zayd (may Allah be pleased with him) say about this?" He said: "He included both the full and paternal sisters together (in inheritance)."
Hadith 2926
حَدَّثَنَا
سَعِيدُ بْنُ الْمُغِيرَةِ، عَنْ
عِيسَى بْنِ يُونُسَ، عَنْ
إِسْمَاعِيل، قَالَ: ذَكَرْنَا عِنْدَ حَكِيمِ بْنِ جَابِر: أَنَّ
ابْنَ مَسْعُودٍ قَالَ فِي أَخَوَاتٍ لِأَبٍ وَأُمٍّ وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ: أَنَّهُ كَانَ يُعْطِي لِلْأَخَوَاتِ مِنْ الْأَبِ وَالْأُمِّ الثُّلُثَيْنِ، وَمَا بَقِيَ فَلِلذُّكُورِ دُونَ الْإِنَاثِ، فَقَالَ
حَكِيمٌ: قَالَ
زَيْدُ بْنُ ثَابِتٍ:
"هَذَا مِنْ عَمَلِ الْجَاهِلِيَّةِ أَنْ يَرِثَ الرِّجَالُ دُونَ النِّسَاءِ إِنَّ إِخْوَتَهُنَّ قَدْ رُدُّوا عَلَيْهِنَّ".
Ismail bin Abi Khalid said: We mentioned to Hakim bin Jabir that Sayyiduna Ibn Mas'ud (may Allah be pleased with him) gives two-thirds to full sisters along with a uterine brother and sister, and whatever remains is distributed only among the men; the women are not given anything. Hakim said: Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: This is the practice of the time of ignorance, that only men inherit instead of women, and their women do not inherit.
Hadith 2927
It is narrated from Masruq (may Allah have mercy on him) that: Sayyida Aisha (may Allah be pleased with her) used to include two daughters and a granddaughter and a grandson in inheritance. Thus, she would give the two daughters two-thirds, and the remaining one-third she would distribute among all of them.
And Sayyiduna Abdullah ibn Mas'ud (may Allah be pleased with him) did not include the granddaughter; whatever remained, he would distribute only among the males, and he used to say: Sisters are in the position of daughters.
Hadith 2928
Shu'bi (may Allah have mercy on him) said: Sayyiduna Ibn Mas'ud (may Allah be pleased with him) used to say regarding a daughter, several granddaughters, and a grandson, that if their share in the division was less than one-sixth, he would still give them one-sixth, and if it was more than one-sixth, he would still give them one-sixth.

Hadith 2929

إِبْرَاهِيمَ، عَنْ
مَسْرُوقٍ: أَنَّهُ كَانَ يُشَرِّكُ فَقَالَ لَهُ عَلْقَمَةُ: هَلْ أَحَدٌ مِنْهُمْ أَثْبَتُ مِنْ عَبْدِ اللَّهِ ؟ فَقَالَ: لَا، وَلَكِنِّي رَأَيْتُ
زَيْدَ بْنَ ثَابِتٍ، وَأَهْلَ الْمَدِينَةِ
"يُشَرِّكُونَ فِي ابْنَتَيْنِ وَبِنْتِ ابْن، ٍوَابْنِ ابْن، وَأُخْتَيْنِ".
It is narrated from Masruq (may Allah have mercy on him) that he used to include the daughter, granddaughter, and two sisters in inheritance. So Alqama said to him: Was there anyone among those who said this more knowledgeable than Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him)? Masruq (may Allah have mercy on him) said: No, but I saw Sayyiduna Zaid bin Thabit (may Allah be pleased with him) and the people of Madinah including them (in inheritance).
Hadith 2930
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ هِشَامٍ، عَنْ مُحَمَّدِ بْنِ سِيرِينَ، عَنْ شُرَيْحٍ: "فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا، وَأُمَّهَا، وَأُخْتَهَا لِأَبِيهَا وَأُمِّهَا، وَأُخْتَهَا لِأَبِيهَا، وَإِخْوَتَهَا لِأُمِّهَا، جَعَلَهَا مِنْ سِتَّةٍ، ثُمَّ رَفَعَهَا فَبَلَغَتْ عَشْرَةً، لِلزَّوْجِ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُخْتِ مِنْ الْأَبِ وَالْأُمِّ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ، وَلِلْأُمِّ السُّدُسُ سَهْمٌ، وَلِلْإِخْوَةِ مِنْ الْأُمِّ الثُّلُثُ سَهْمَانِ، وَلِلْأُخْتِ مِنْ الْأَبِ سَهْمٌ تَكْمِلَةُ الثُّلُثَيْنِ".
Muhammad bin Sirin (may Allah have mercy on him) narrated from Qadi Shurayh that a woman left behind her husband, mother, full sister, paternal sister, and maternal brother. He divided the inheritance from six shares and increased it to ten. He gave the husband three shares (i.e., half of six), the full sister the remaining three shares, i.e., half, then the mother one-sixth (one share), the maternal brothers one-third, i.e., two shares, and the paternal sister, to complete two-thirds, one share.
