Hadith 2922
أَخْبَرَنَا
أَبُو نُعَيْمٍ، حَدَّثَنَا
زُهَيْرٌ، عَنْ
أَبِي إِسْحَاق، عَنْ
الْحَارِثِ الْأَعْوَرِ، قَالَ: أُتِيَ
عَبْدُ اللَّهِ فِي فَرِيضَةِ بَنِي عَمٍّ، أَحَدُهُمْ أَخٌ لِأُمٍّ، فَقَالَ: الْمَالُ أَجْمَعُ لِأَخِيهِ لِأُمِّه، فَأَنْزَلَهُ بِحِسَابِ، أَوْ بِمَنْزِلَةِ الْأَخِ مِنْ الْأَبِ وَالْأُمِّ، فَلَمَّا قَدِمَ
عَلِيٌّ، سَأَلْتُهُ عَنْهَا، وَأَخْبَرْتُهُ بِقَوْلِ عَبْدِ اللَّهِ، فَقَالَ: "يَرْحَمُهُ اللَّهُ، إِنْ كَانَ لَفَقِيهًا، أَمَّا أَنَا
فَلَمْ أَكُنْ لِأَزِيدَهُ عَلَى مَا فَرَضَ اللَّهُ لَهُ: سَهْمٌ السُّدُسُ، ثُمَّ يُقَاسِمُهُمْ كَرَجُلٍ مِنْهُمْ".
Harith al-A'war said: A case regarding the Banu 'Am (paternal cousins) was brought to Abdullah bin Mas'ud (may Allah be pleased with him), among whom there was a maternal brother. He said: All the wealth will go to the maternal (uterine) brother, as if he considered the maternal brother to be on the level of an heir by calculation or a real brother. Then when Ali (may Allah be pleased with him) arrived, I presented this issue before him and informed him of the decision of Abdullah bin Mas'ud (may Allah be pleased with him). He said: May Allah have mercy on him, he was indeed understanding (a jurist), but I will not give more in this case than what Allah Almighty has prescribed; for him is a sixth (one-sixth), then the remainder will be divided among them as if he were one of them (see details in the explanation below).
Hadith 2923

مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا
سُفْيَانُ، عَنْ
أَبِي إِسْحَاق، عَنْ
الْحَارِثِ، عَنْ عَلِي: أَنَّهُ أُتِيَ فِي ابْنَيْ عَمٍّ أَحَدُهُمَا أَخٌ لِأُمٍّ، فَقِيلَ لِعَلِيٍّ: إِنَّ ابْنَ مَسْعُودٍ كَانَ يُعْطِيهِ الْمَالَ كُلَّهُ، فَقَالَ
عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: إِنْ كَانَ لَفَقِيهًا، وَلَوْ كُنْتُ أَنَا
"أَعْطَيْتُهُ السُّدُسَ، وَمَا بَقِيَ كَانَ بَيْنَهُمْ".
Harith al-A'war narrated that a case regarding Banu 'Am was brought to Sayyiduna Ali (may Allah be pleased with him), among whom one was his maternal brother. Sayyiduna Ali (may Allah be pleased with him) was informed that Sayyiduna Ibn Mas'ud (may Allah be pleased with him) had made him the heir of the entire wealth. Sayyiduna Ali (may Allah be pleased with him) said: He is indeed a jurist, but if I were in his place, I would have given him one-sixth, and whatever remained, I would have distributed among all the Banu 'Am.
