Hadith 2663
أَخْبَرَنَا
يَعْلَى، حَدَّثَنَا
عَبْدُ الْمَلِكِ، عَنْ
عَطَاءٍ، عَنْ
جَابِرٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الشُّفْعَةِ إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا ؟ . قَالَ:
"يُنْظَرُ بِهَا، وَإِنْ كَانَ صَاحِبُهَا غَائِبًا".
It is narrated from Sayyiduna Jabir (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said regarding pre-emption (shuf‘ah): "When both neighbors share the same path, the (neighbor) will be waited for on account of pre-emption, even if he is absent."
Hadith 2664
أَخْبَرَنَا
مُحَمَّدُ بْنُ الْعَلَاءِ، حَدَّثَنَا
عَبْدُ اللَّهِ بْنُ إِدْرِيسَ، عَنْ
ابْنِ جُرَيْجٍ، عَنْ
أَبِي الزُّبَيْرِ، عَنْ
جَابِرٍ، قَالَ:
"قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ: رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ، فَإِنْ شَاءَ، أَخَذَ، وَإِنْ شَاءَ، تَرَكَ، فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ، فَهُوَ أَحَقُّ بِهِ" . قِيلَ لِأَبِي مُحَمَّدٍ: تَقُولُ بِهَذَا ؟ . قَالَ: نَعَمْ.
Sayyiduna Jabir (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) gave the verdict of pre-emption (shuf‘ah) in every joint property that has not been divided, whether it is land or a garden. It is not good for one partner to sell (his share) without the permission of the other partner. The partner has the choice: if he wishes, he may take it, and if he wishes, he may leave it. And if one partner sells his share without informing the other partner, then the (other partner) has more right to it.
Imam Darimi (may Allah have mercy on him) was asked: Do you also say the same? He replied: Yes (i.e., he has the right of pre-emption; by giving the same amount that the partner received, he can take his share from the outsider).
