باب كَمِ الدِّيَةُ مِنَ الْوَرِقِ وَالذَّهَبِ:
Chapter: Amount of Blood Money in Silver and Gold
Hadith 2400
حَدَّثَنَا مُعَاذُ بْنُ هَانِئٍ، حَدَّثَنَا مُحَمَّدُ بْنُ مُسْلِمٍ، حَدَّثَنَا عَمْرُو بْنُ دِينَارٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قالَ: قَتَلَ رَجُلٌ رَجُلًا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ "فَجَعَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دِيَتَهُ اثْنَيْ عَشَرَ أَلْفًا فَذَلِكَ قَوْلُهُ: يَحْلِفُونَ بِاللَّهِ مَا قَالُوا وَلَقَدْ قَالُوا كَلِمَةَ الْكُفْرِ وَكَفَرُوا بَعْدَ إِسْلامِهِمْ وَهَمُّوا بِمَا لَمْ يَنَالُوا وَمَا نَقَمُوا إِلا أَنْ أَغْنَاهُمُ اللَّهُ وَرَسُولُهُ مِنْ فَضْلِهِ سورة التوبة آية 74 بِأَخْذِهِمُ الدِّيَةَ".
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: In the time of the Messenger of Allah (peace and blessings be upon him), a man killed another man. The Prophet (peace and blessings be upon him) set his blood money at twelve thousand dirhams. This was because in the noble verse it is stated, translation: "They swear by Allah that they did not say (it), but certainly the word of disbelief has come out of their mouths, and they disbelieved after their Islam, and they intended that which they could not attain. And they were not angry except due to the fact that Allah and His Messenger had enriched them from His bounty." (al-Tawbah: 74/9) That is, by taking the blood money.
Hadith 2401
حَدَّثَنَا الْحَكَمُ بْنُ مُوسَى، حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ، عَنْ سُلَيْمَانَ بْنِ دَاوُدَ، قَالَ: حَدَّثَنِي الزُّهْرِيُّ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى أَهْلِ الْيَمَنِ: "وَعَلَى أَهْلِ الذَّهَبِ أَلْفُ دِينَارٍ".
It is narrated from Sayyiduna Amr bin Hazm (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) wrote to the people of Yemen: "For those who possess gold, the blood money is one thousand dinars."
