باب مَا لاَ يُقْطَعُ فِيهِ مِنَ الثِّمَارِ:
Chapter: No Amputation for Certain Fruits
Hadith 2341
أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، أَخْبَرَنَا يَحْيَى هُوَ ابْنُ سَعِيدٍ، أَنَّ مُحَمَّدَ بْنَ يَحْيَى بْنِ حَبَّانَ أَخْبَرَهُ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ: "لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ".
Sayyiduna Rafi‘ bin Khadij (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) saying: “There is no cutting of the hand for stealing fruit and clusters.”
Hadith 2342
حَدَّثَنَا الْحُسَيْنُ بْنُ مَنْصُورٍ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ رَجُلٍ مِنْ قَوْمِهِ، عَنْ رَافِعِ بْنِ خَدِيجٍ، عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , قَالَ: "لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ".
It is narrated through this chain as well, similar to the previous narration. The translation of the hadith has already been mentioned above.
Hadith 2343
أَخْبَرَنَا إِسْحَاق، حَدَّثَنَا وَكِيعٌ، عَنْ سُفْيَانَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ عَمِّهِ وَاسِعِ بْنِ حَبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ" .
With this chain as well, it is narrated similarly as before. The translation of the hadith has already been mentioned above.
Hadith 2344
حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا سُفْيَانُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ.
It is narrated through this chain as well, similar to the previous narration. The translation of the hadith has already been mentioned above.
Hadith 2345
أَخْبَرَنَا إِسْحَاق، حَدَّثَنَا جَرِيرٌ، وَالثَّقَفِيُّ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَخْبَرَنِي مُحَمَّدُ بْنُ يَحْيَى بْنِ حَبَّانَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , يَقُولُ: "لَا قَطْعَ فِي ثَمَرٍ وَلَا كَثَرٍ" . قَالَ: وَهُوَ شَحْمُ النَّخْلِ . وَالْكَثَرُ: الْجُمَّارُ.
Sayyiduna Rafi‘ bin Khadij (may Allah be pleased with him) said that I heard the Messenger of Allah (peace and blessings be upon him) saying: "The hand should not be cut for stealing fruit and clusters." The narrator said: The white membrane inside the date is called kasar, and kasar is the cluster that is on the date palm tree.
Hadith 2346
أَخْبَرَنَا سَعِيدُ بْنُ مَنْصُورٍ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، عَنْ أَبِي مَيْمُونٍ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، يَقُولُ: "لَا قَطْعَ فِي كَثَرٍ" . قَالَ أَبُو مُحَمَّد: الْقَوْلُ مَا قَالَ أَبُو أُسَامَةَ.
The translation of this hadith has already been mentioned above. Imam Darimi, may Allah have mercy on him, said: What Abu Usamah (his name is Hammad bin Usamah) said is correct.
