باب في تَخْيِيرِ الأَمَةِ تَكُونُ تَحْتَ الْعَبْدِ فَتُعْتَقُ:
Chapter: Giving a Freed Slave Woman the Choice After Emancipation
Hadith 2326
أَخْبَرَنَا سَهْلُ بْنُ حَمَّادٍ، حَدَّثَنَا شُعْبَةُ، عَنْ الْحَكَمِ، عَنْ إِبْرَاهِيمَ، عَنْ الْأَسْوَدِ، عَنْ عَائِشَةَ: أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ، فَأَرَادَ مَوَالِيهَا أَنْ يَشْتَرِطُوا وَلَاءَهَا، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: "اشْتَرِيهَا، فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ"، فَاشْتَرَتْهَا فَأَعْتَقَتْهَا، وَخَيَّرَهَا مِنْ زَوْجِهَا وَكَانَ حُرًّا وَأَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُتِيَ بِلَحْمٍ، فَقَالَ: "مِنْ أَيْنَ هَذَا ؟"قِيلَ: تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ، فَقَالَ: "هُوَ لَهَا صَدَقَةٌ، وَلَنَا هَدِيَّةٌ".
It is narrated from Sayyida Aisha (may Allah be pleased with her) that when she intended to purchase Sayyida Barirah (may Allah be pleased with her), her owners stipulated a condition regarding Sayyida Barirah’s inheritance for themselves (i.e., we will sell her but her wala’ [right of inheritance/loyalty] will be for us). Sayyida Aisha (may Allah be pleased with her) mentioned this to the Messenger of Allah (peace and blessings be upon him). He (peace and blessings be upon him) said: “Buy Barirah, for the wala’ belongs to the one who frees the slave, whether male or female.” Sayyida Aisha (may Allah be pleased with her) said: So I bought Barirah and set her free, and the Prophet (peace and blessings be upon him) gave her the choice to stay with her husband, who was a free man. And meat was presented to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) asked: “Where did this come from?” It was said: It was given as charity to Barirah. He (peace and blessings be upon him) said: “It was charity for her, but for us it is a gift from her.”
Hadith 2327
أَخْبَرَنَا إِسْمَاعِيل بْنُ خَلِيلٍ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، حَدَّثَنَا هِشَامُ بْنُ عُرْوَةَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، قَالَتْ: دَخَلَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَيَّ فَقَرَّبْتُ إِلَيْهِ طَعَامًا لَيْسَ فِيهِ لَحْمٌ، فَقَالَ: "أَلَمْ أَرَ لَكُمْ قِدْرًا مَنْصُوبَةً ؟"قُلْتُ: يَا رَسُولَ اللَّهِ، هَذَا لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ، فَأَهْدَتْ لَنَا، قَالَ: "هُوَ عَلَيْهَا صَدَقَةٌ، وَهُوَ لَنَا مِنْهَا هَدِيَّةٌ"، وَكَانَ لَهَا زَوْجٌ، فَلَمَّا عُتِقَتْ، خُيِّرَتْ.
Lady Aisha (may Allah be pleased with her) said: The Noble Prophet (peace and blessings be upon him) came to me and I presented food to him in which there was no meat. He (peace be upon him) said: "Do I not see a pot of meat cooking for you?" I replied: O Messenger of Allah (peace be upon him)! That meat was given to Barirah as charity, and Barirah gave it to us as a gift, and you do not eat from charity. He (peace be upon him) said: "It was charity for her and a gift for us from Barirah." And her (Barirah's) husband was there; when she was freed, she was given the choice regarding her husband.
Hadith 2328
أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ الضَّحَّاكِ، عَنْ الْمُغِيرَةِ بْنِ عَبْدِ الرَّحْمَنِ الْمَخْزُومِيِّ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ: "أَنَّ بَرِيرَةَ حِينَ أَعْتَقَتْهَا عَائِشَةُ، كَانَ زَوْجُهَا عَبْدًا، فَجَعَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَحُضُّهَا عَلَيْهِ، فَجَعَلَتْ تَقُولُ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَلَيْسَ لِي أَنْ أُفَارِقَهُ ؟ قَالَ: "بَلَى"، قَالَتْ: فَقَدْ فَارَقْتُهُ.
It is narrated from Sayyida Aisha (may Allah be pleased with her) that when she freed Sayyida Barirah (may Allah be pleased with her), at that time her husband was a slave. And the Messenger of Allah (peace and blessings be upon him) used to encourage her regarding her husband (not to leave him), and she kept saying: "Do I not have the choice to separate from him?" He said: "Yes, you do have the choice." So Sayyida Barirah (may Allah be pleased with her) said: "Then I have separated from him."
Hadith 2329
أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ، أَخْبَرَنَا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ خَالِدٍ يَعْنِي الْحَذَّاءَ عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ: أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا يُقَالُ لَهُ: مُغِيثٌ، كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْعَبَّاسِ: "يَا عَبَّاسُ، أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ، وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا ؟"فَقَالَ لَهَا: "لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ"، فَقَالَتْ: يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي ؟ قَال: "إِنَّمَا أَنَا شَافِعٌ"، قَالَتْ: لَا حَاجَةَ لِي فِيهِ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated that Sayyidah Barirah’s (may Allah be pleased with her) husband was a slave whose name was Mughith. It is as if I am seeing him circumambulating behind Sayyidah Barirah (may Allah be pleased with her), and his beard is wet with tears. The Noble Prophet (peace and blessings be upon him) said to Sayyiduna Abbas (may Allah be pleased with him): “O Abbas! Do you not find it astonishing how much Mughith loves Barirah and how much Barirah dislikes Mughith?” The Messenger of Allah (peace and blessings be upon him) said to Sayyidah Barirah (may Allah be pleased with her): “Consider your decision, for he is the father of your child.” Sayyidah Barirah (may Allah be pleased with her) said: O Messenger of Allah (peace and blessings be upon him)! Is this your command? He replied: “No, I am only interceding.” Sayyidah Barirah (may Allah be pleased with her) said: Then (there is no need for me to reconsider), and I do not want Mughith.
